1 An Act concerning alcoholic beverage control relating
2 to alternating proprietorship arrangements for beer
3 manufacturers.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 123.130, Code 2023, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 4A. a. For purposes of this subsection,
4 “manufacturer” includes only those persons who hold a class “A”
5 beer permit and manufacture beer in Iowa.
6 b. A manufacturer may use the space and equipment of
7 another manufacturer for the purpose of manufacturing beer,
8 provided that such an alternating proprietorship arrangement
9 is approved by the alcohol and tobacco tax and trade bureau of
10 the United States department of the treasury. A separate class
11 “A” beer permit shall be issued to each manufacturer, and each
12 manufacturer shall be subject to the provisions of this chapter
13 and the rules of the division. Notwithstanding subsection 2,
14 not more than one class “C” retail alcohol license shall be
15 issued to a premises with alternating proprietorships.
16 EXPLANATION
17 The inclusion of this explanation does not constitute agreement with
18 the explanation’s substance by the members of the general assembly.
19 This bill allows a manufacturer of beer in Iowa to use the
20 space and equipment of another manufacturer of beer in Iowa for
21 the purpose of manufacturing beer pursuant to an alternating
22 proprietorship arrangement that is approved by the alcohol and
23 tobacco tax and trade bureau of the United States department
24 of the treasury. The bill provides that no more than one class
25 “C” retail alcohol license shall be issued to a premises with
26 alternating proprietorships for beer.
