1 An Act relating to the regulation of energy sources by counties
2 and cities.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 331.301, Code 2023, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 22. a. For purposes of this subsection,
4 “energy source” means any fuel or power source used to power an
5 engine, including but not limited to aviation fuel, biofuel,
6 compressed or liquefied natural gas, diesel fuel including
7 renewable diesel and biodiesel blended fuel, electricity used
8 for charging electric vehicles, gasoline including ethanol
9 blended gasoline, gas distillates, hydrogen, and liquefied
10 petroleum gas.
11 b. A county shall not adopt an ordinance, motion,
12 resolution, or amendment that limits consumer access to an
13 energy source or that results in the de facto prohibition of
14 the sale or production of an energy source or the related
15 infrastructure necessary to provide consumer access to a
16 specific energy source within the county’s jurisdiction.
17 Sec. 2. Section 364.3, Code 2023, is amended by adding the
18 following new subsection:
19 NEW SUBSECTION. 18. a. For purposes of this subsection,
20 “energy source” means any fuel or power source used to power an
21 engine, including but not limited to aviation fuel, biofuel,
22 compressed or liquefied natural gas, diesel fuel including
23 renewable diesel and biodiesel blended fuel, electricity used

27 b. A city shall not adopt an ordinance, motion, resolution,
28 or amendment that limits consumer access to an energy source
29 or that results in the de facto prohibition of the sale or
30 production of an energy source or the related infrastructure
31 necessary to provide consumer access to a specific energy
32 source within the city’s jurisdiction.
33 EXPLANATION
34 The inclusion of this explanation does not constitute agreement with
35 the explanation’s substance by the members of the general assembly.

1 This bill prohibits a county or city from adopting an
2 ordinance, motion, resolution, or amendment that limits
3 consumer access to an energy source or that results in the de
4 facto prohibition of the sale or production of an energy source
5 or the related infrastructure necessary to provide consumer
6 access to a specific energy source within the jurisdiction of
7 the county or city. The bill defines “energy source”.
