1 An Act relating to allowable forms of payment for amusement
2 concessions at an amusement park and an arcade.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 99B.1, Code 2023, is amended by adding
2 the following new subsections:
3 NEW SUBSECTION. 2A. “Amusement park” means any permanent
4 facility or park where amusement rides, as defined in section
5 88A.1, are available for use by the public.
6 NEW SUBSECTION. 3A. “Arcade” means any permanent facility
7 or a distinct part of a permanent facility principally devoted
8 to offering amusement or entertainment by means of amusement
9 concessions or nongambling games.
10 Sec. 2. Section 99B.5, subsection 2, Code 2023, is amended
11 to read as follows:
12 2. Except as provided by subsection 1, a participant in
13 an activity authorized by this chapter may make payment by
14 cash, personal check, money order, bank check, cashier’s check,
15 electronic check, or debit card. In addition, a participant in
16 an amusement concession as authorized by this chapter at a fair
17 as authorized by this chapter, amusement park, or arcade, may
18 also make payment by credit card.
19 EXPLANATION
20 The inclusion of this explanation does not constitute agreement with
21 the explanation’s substance by the members of the general assembly.
22 This bill provides that a participant in an amusement
23 concession as authorized by Code chapter 99B at an amusement
24 park or an arcade may also make payment by credit card. For
25 purposes of Code chapter 99B, the bill defines “amusement park”
26 as any permanent facility where amusement rides are available
27 for use by the public, and “arcade” as any permanent facility
28 devoted to offering amusement or entertainment by means of
29 amusement concessions or nongambling games.
