1 An Act relating to the provision of period products.
2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 8H.1 Provision of period products.
2 1. The entity with authority over a state building shall
3 ensure that period products are available, at no cost, in the
4 restrooms of the state building.
5 2. For the purpose of this section:
6 a. “Period products” means tampons and period pads for use
7 in connection with the menstrual cycle.
8 b. “State agency” means a unit of state government, which
9 is an authority, board, commission, committee, council,
10 department, or independent agency as defined in section 7E.4,
11 including but not limited to each principal central department
12 enumerated in section 7E.5. However, “state agency” does not
13 mean any of the following:
14 (1) The office of the governor or the office of an elective
15 constitutional or statutory officer.
16 (2) The general assembly, or any office or unit under its
17 administrative authority.
18 (3) The judicial branch, as provided in section 602.1102.
19 (4) A political subdivision of the state or its offices or
20 units, including but not limited to a county or city, but not
21 including a community college.
22 c. “State building” means a public facility or building
23 owned, leased, or operated by or under the control of the
24 state government, a state agency, the state department of
25 transportation, the state board of regents, or the Iowa state
26 fair board.
27 Sec. 2. NEW SECTION. 218.101 Provision of period products.
28 Institutions controlled by the director of health and
29 human services specified in section 218.1 shall make period
30 products available, at no cost, to residents or patients of
31 the institutions in locations and as appropriate to the health
32 care needs of the residents or patients, and to staff and the
33 public, in the restrooms of the institutions. As used in this
34 section, “period products” means tampons and period pads for use
35 in connection with the menstrual cycle.

2 The superintendent shall make period products available, at
3 no cost, to students, staff, and the public in the restrooms
4 of school buildings and of each campus building frequented by
5 students, staff, and the public. As used in this section,
6 “period products” means tampons and period pads for use in
7 connection with the menstrual cycle.
8 Sec. 4. NEW SECTION. 280.33 Provision of period products.
9 1. The board of directors of each public school district and
10 the authorities in charge of each nonpublic school shall ensure
11 that period products are available, at no cost, to students,
12 staff, and the public in the restrooms of school buildings.
13 2. For the purposes of this section:
14 a. “Period products” means tampons and period pads for use
15 in connection with the menstrual cycle.
16 b. “School building” means any facility that is owned or
17 leased by a public school district or nonpublic school over
18 which the board or authorities have care, custody, and control.
19 Sec. 5. NEW SECTION. 904.517 Provision of period products.
20 The department shall ensure that period products are
21 available to offenders committed to the institutions specified
22 in section 904.102 at no cost and in a quantity and as
23 appropriate to the health care needs of the individual
24 offender. The department shall also ensure that period
25 products are available, at no cost, for staff and the public in
26 the restrooms of the institutions. For the purposes of this
27 section, “period products” means tampons and period pads for use
28 in connection with the menstrual cycle.
29 EXPLANATION
30 The inclusion of this explanation does not constitute agreement with
31 the explanation’s substance by the members of the general assembly.
32 This bill requires period products to be available at no cost
33 in certain buildings, institutions, and facilities under the
34 control of the state and in schools.
35 The bill requires that the entity with authority over a state

1 building shall ensure that period products are available, at no
2 cost, in the restrooms of the state building.
3 The bill requires that institutions controlled by the
4 director of the department of health and human services make
5 period products available, at no cost, to residents or patients
6 of the institutions in locations and as appropriate to the
7 health care needs of the residents or patients, and to staff
8 and the public, in the restrooms of the institutions.
9 The bill requires the superintendent of the school for
10 the deaf to make period products available, at no cost, to
11 students, staff, and the public in the restrooms of school
12 buildings and of each campus building frequented by students,
13 staff, and the public.
14 The bill requires the board of directors of each public
15 school district and the authorities in charge of each nonpublic
16 school to ensure that period products are available, at no
17 cost, to students, staff, and the public in the restrooms of
18 school buildings.
19 The bill requires that the department of corrections
20 ensure that period products are available to offenders
21 committed to the institutions at no cost and in a quantity
22 and as appropriate to the health care needs of the individual
23 offender. The bill also requires the department of corrections
24 to ensure that period products are available, at no cost, to
25 staff and the public, in the restrooms of institutions.
26 For the purposes of the bill, “period products” means
27 tampons and period pads for use in connection with the
28 menstrual cycle.
