1 An Act relating to the dispensing of abortion-inducing drugs to
2 patients within the state, and providing penalties.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 146E.1 Dispensing of
2 abortion-inducing drugs —— penalty.
3 1. A person shall not dispense an abortion-inducing drug
4 to a patient in this state for use by such patient in inducing
5 a medication abortion unless the abortion-inducing drug is
6 dispensed directly to such patient in a health care setting.
7 2. A person who intentionally, knowingly, or recklessly
8 violates this section is guilty of a serious misdemeanor.
9 3. For the purposes of this section:
10 a. “Abortion” means the termination of a human pregnancy
11 with the intent other than to produce a live birth or to remove
12 a dead fetus.
13 b. “Abortion-inducing drug” means a drug, medicine, mixture,
14 or preparation when prescribed or administered with the intent
15 to terminate the pregnancy of a woman known to be pregnant.
16 “Abortion-inducing drug” includes mifepristone and misoprostol.
17 c. “Dispense” means relative to an abortion-inducing drug,
18 to deliver the abortion-inducing drug to the ultimate user.
19 d. “Health care setting” means a clinic, medical office, or
20 hospital.
21 e. “Medication abortion” means an abortion performed by the
22 administration or use of an abortion-inducing drug.
23 EXPLANATION
24 The inclusion of this explanation does not constitute agreement with
25 the explanation’s substance by the members of the general assembly.
26 This bill prohibits a person from dispensing an
27 abortion-inducing drug to a patient in this state for use by
28 such patient in inducing a medication abortion unless the
29 abortion-inducing drug is dispensed directly to such patient in
30 a health care setting.
31 A person who intentionally, knowingly, or recklessly
32 violates the bill is guilty of a serious misdemeanor. A
33 serious misdemeanor is punishable by confinement for no more
34 than one year and a fine of at least $430 but not more than
35 $2,560.
