1 An Act relating to the operation of registered all-terrain
2 vehicles and off-road utility vehicles on secondary roads.

1 Section 1. Section 321.234A, subsection 1, paragraph f,
2 Code 2022, is amended to read as follows:
3 f. The all-terrain vehicle is operated on a county roadway
4 secondary road in accordance with section 321I.10, subsection
5 2, or a city street in accordance with section 321I.10,
6 subsection 3.
7 Sec. 2. Section 321I.10, subsection 2, Code 2022, is amended
8 to read as follows:
9 2. A registered all-terrain vehicle or off-road utility
10 vehicle may be operated on the roadways of that portion of
11 county highways designated by the county board of supervisors
12 for such use during a specified period secondary roads.
13 The county board of supervisors shall evaluate the traffic
14 conditions on all county highways and designate roadways on
15 which all-terrain vehicles or off-road utility vehicles may be
16 operated for the specified period without unduly interfering
17 with or constituting an undue hazard to conventional motor
18 vehicle traffic. In designating such roadways, the board may
19 authorize all-terrain vehicles and off-road utility vehicles
20 to stop at service stations or convenience stores along a
21 designated roadway.
22 Sec. 3. Section 331.301, Code 2022, is amended by adding the
23 following new subsection:
24 NEW SUBSECTION. 21. A county shall not adopt an ordinance,
25 motion, resolution, or amendment, or use any other means, that
26 prohibits or regulates the operation of registered all-terrain
27 vehicles or off-road utility vehicles on secondary roads within
28 its jurisdiction, unless otherwise authorized by state law.
29 Sec. 4. Section 331.362, subsection 9, Code 2022, is amended
30 to read as follows:
31 9. A county may regulate traffic on and use of the secondary
32 roads, in accordance with sections 321.236 through 321.239,
33 321.241, 321.247 through 321.250, 321.254, 321.255, 321.285,
34 subsection 4, sections 321.352, 321.471 through 321.473, and
35 other applicable provisions of chapter 321, chapter 321E, and

1 sections 321G.9, 321I.10, and 327G.15.
2 EXPLANATION
3 The inclusion of this explanation does not constitute agreement with
4 the explanation’s substance by the members of the general assembly.
5 Under current law, a registered all-terrain vehicle (ATV)
6 or off-road utility vehicle (UTV) may be operated on a county
7 highway designated by the county board of supervisors for such
8 use during a specified period. The county board of supervisors
9 is required to evaluate the traffic conditions on all county
10 highways and designate roadways on which ATVs and UTVs may be
11 operated for the specified period without unduly interfering
12 with or constituting an undue hazard to conventional motor
13 vehicle traffic. In designating such roadways, the board is
14 allowed but not required to authorize ATVs and UTVs to stop
15 at service stations or convenience stores along a designated
16 roadway.
17 This bill allows registered ATVs and UTVs to operate on all
18 secondary roads (those roads under county jurisdiction). The
19 bill strikes the authority of a county board of supervisors
20 to regulate the operation of registered ATVs and UTVs and
21 prohibits a county from adopting an ordinance, motion,
22 resolution, or amendment, or using any other means, that
23 prohibits or regulates the operation of registered ATVs
24 and UTVs on secondary roads within its jurisdiction, unless
25 otherwise authorized by state law.
