SENATE CONCURRENT RESOLUTION NO. 101

1 A Concurrent Resolution urging the United States Drug
2 Enforcement Administration to grant an exception to
3 the classification of cannabis under schedule I of
4 the federal Controlled Substances Act in Iowa.
5 WHEREAS, the General Assembly has directed the Iowa
6 Department of Public Health to request guarantees from
7 the federal government that educational and long-term
8 care facilities in Iowa with policies allowing patients
9 to possess medical cannabidiol or allowing staff to
10 administer medical cannabidiol will not lose federal
11 funding due to such policies; and
12 WHEREAS, the Iowa Department of Public Health may
13 accomplish this goal by seeking an exception to the
14 classification of cannabis under schedule I of the
15 federal Controlled Substances Act in Iowa from the
16 United States Drug Enforcement Administration using the
17 procedure found in 21 C.F.R. ยง1307.03; NOW THEREFORE,
18 BE IT RESOLVED BY THE SENATE, THE HOUSE OF
19 REPRESENTATIVES CONCURRING, That the Iowa General
20 Assembly urges the United States Drug Enforcement
21 Administration to grant an exception to the
22 classification of cannabis under schedule I of the
23 federal Controlled Substances Act in Iowa requested by
24 the Iowa Department of Public Health for the purpose
25 of allowing the possession and administration of
26 medical cannabidiol at educational and long-term care
27 facilities in Iowa; and
28 BE IT FURTHER RESOLVED, That the Secretary of State

1 transmit a copy of this resolution to the Office of
2 Diversion Control of the federal Drug Enforcement
3 Administration.
