1 An Act relating to massage therapy, including child and
2 dependent adult abuse reporting and continuing education
3 requirements, and making penalties applicable.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 152C.3, subsection 2, paragraph a, Code
2 2022, is amended to read as follows:
3 a. (1) Requirements regarding completion of at least twelve
4 hours of continuing education annually regarding subjects
5 concerning massage and related techniques or the health and
6 safety of the public, subject to reduction by the board if,
7 after public notice and hearing, the board determines that the
8 welfare of the public may be adequately protected with fewer
9 hours.
10 (2) The board shall allow a licensed massage therapist
11 to include each hour of completed training required pursuant
12 to sections 232.69 and 235B.16 toward the annual continuing
13 education requirement.
14 Sec. 2. Section 232.69, subsection 1, paragraph b, Code
15 2022, is amended by adding the following new subparagraph:
16 NEW SUBPARAGRAPH. (15) A massage therapist licensed
17 pursuant to chapter 152C.
18 Sec. 3. Section 235B.3, subsection 2, Code 2022, is amended
19 by adding the following new paragraph:
20 NEW PARAGRAPH. i. A massage therapist licensed pursuant to
21 chapter 152C.
22 EXPLANATION
23 The inclusion of this explanation does not constitute agreement with
24 the explanation’s substance by the members of the general assembly.
25 This bill relates to the practice of massage therapy.
26 The bill adds licensed massage therapists to the list of
27 persons required to report child and dependent adult abuse.
28 By operation of law, such persons are required to complete
29 training regarding the identification and reporting of child
30 and dependent adult abuse, and the board of massage therapy
31 is required to require the completion of such training as a
32 condition of licensure. The bill allows a licensed massage
33 therapist to include the completion of such training toward the
34 fulfillment of the continuing education requirement.

1 dependent adult abuse who knowingly and willfully fails to do
2 so is guilty of a simple misdemeanor. A simple misdemeanor is
3 punishable by confinement for no more than 30 days and a fine
4 of at least $105 but not more than $855. A person required to
5 report suspected child or dependent adult abuse who knowingly
6 fails to do so is civilly liable for the damages proximately
7 caused by such a failure.
