1 A Resolution declaring the intent of the House of
2 Representatives to do all that is in its power to
3 protect the constitutional right of Iowans to keep
4 and bear arms.
5 WHEREAS, the Second Amendment to the Constitution
6 of the United States protects the individual right to
7 keep and bear arms; and
8 WHEREAS, the United States Supreme Court has found
9 that the Second Amendment to the Constitution of the
10 United States protects the right of individuals to
11 possess any bearable arm commonly used for lawful
12 purposes; and
13 WHEREAS, the President of the United States has
14 made clear his intent to press Congress to impose
15 legislation and to otherwise implement and enforce
16 executive orders, agency orders, rules, and regulations
17 that would restrict the lawful acquisition, possession,
18 and use of firearms and ban many common firearms used
19 for self-defense, hunting, competition, and target

1 shooting; and
2 WHEREAS, the United States Supreme Court has
3 recognized that the principles of separate sovereignty,
4 as embodied in the Tenth Amendment to the Constitution
5 of the United States, prohibit the federal government
6 from requiring Iowa or its officers to take part in any
7 federal gun-control scheme; and
8 WHEREAS, it is the duty of the House of
9 Representatives to exercise all of its lawful authority
10 to protect the right of all Iowans to keep and bear
11 arms; NOW THEREFORE,
12 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, That
13 it is the intent of the House of Representatives to
14 oppose and not support the enactment and implementation
15 of any federal law, executive order, agency order,
16 rule, or regulation that violates the Constitution of
17 the United States and threatens the fundamental right
18 to keep and bear arms; and
19 BE IT FURTHER RESOLVED, That the House of
20 Representatives, on behalf of the citizens of Iowa,
21 hereby intends to use all of its lawful authority and
22 power to resist or overturn any federal gun-control
23 measure that violates the right of Iowans to keep and
24 bear arms.
