A BILL FOR
1 An Act prohibiting the mandatory disclosure of whether a person
2 has received a vaccination for COVID-19, disqualifying
3 certain entities from receiving state grants or contracts,
4 and including effective date provisions.
5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 27B.1 Vaccine information on
2 identification cards —— prohibited.
3 The state or any political subdivision of the state shall
4 not include on an identification card issued by the state or
5 political subdivision information regarding whether the holder
6 of the identification card has received a vaccination for
7 COVID-19, as defined in section 686D.2.
8 Sec. 2. NEW SECTION. 27B.2 Proof of vaccination —— denial
9 of state grants or contracts.
10 1. Notwithstanding any provision of law to the contrary, a
11 business or governmental entity shall not require a customer,
12 patron, client, patient, or other person who is invited onto
13 the premises of the business or governmental entity to furnish
14 proof of having received a vaccination for COVID-19, as defined
15 in section 686D.2, prior to entering onto the premises of
16 the business or governmental entity. This section does not
17 prohibit a business or governmental entity from implementing
18 a COVID-19 screening protocol that does not require proof of
19 vaccination for COVID-19.
20 2. Notwithstanding any provision of law to the contrary,
21 grants or contracts funded by state revenue shall not
22 be awarded to or renewed with respect to a business or
23 governmental entity that violates subsection 1 on or after the
24 effective date of this Act.
25 3. For the purposes of this section:
26 a. “Business” means a retailer required to obtain a
27 sales tax permit pursuant to chapter 423, a nonprofit or
28 not-for-profit organization, or an establishment which is open
29 to the public at large or where entrance is limited by a cover
30 charge or membership requirement, but does not include a health
31 care facility as defined in section 686D.2.
32 b. “Governmental entity” means the state or any political
33 subdivision of the state that owns, leases, or operates
34 buildings under the control of the state or a political
35 subdivision of the state, but does not include a health care

1 facility as defined in section 686D.2.
2 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate
3 importance, takes effect upon enactment.
4 EXPLANATION
5 The inclusion of this explanation does not constitute agreement with
6 the explanation’s substance by the members of the general assembly.
7 This bill relates to proof of vaccination for COVID-19.
8 The bill prohibits the state or any political subdivision of
9 the state from including on an identification card issued
10 by the state or political subdivision information regarding
11 whether the holder of the identification card has received a
12 vaccination for COVID-19.
13 The bill also prohibits a business or governmental entity,
14 defined in the bill, from requiring a customer, patron, client,
15 patient, or other person who is invited onto the premises to
16 furnish proof of having received a vaccination for COVID-19
17 prior to entering a premises of a business or governmental
18 entity. The bill makes any business or governmental entity
19 that requires such proof ineligible to receive grants and
20 contracts funded by state revenue. The bill does not prohibit
21 a business or governmental entity from implementing a COVID-19
22 screening protocol that does not require proof of vaccination
23 for COVID-19.
24 The bill takes effect upon enactment.
