A BILL FOR
1 An Act relating to information to be provided, recorded, and
2 reported by health care providers and health professionals
3 relative to vaccinations and immunizations, and providing
4 for licensee discipline.

1 Section 1. NEW SECTION. 135.39E Vaccinations —— health care
2 provider requirements.
3 1. For the purposes of this section, “health care provider”
4 means any licensed health care professional, organization, or
5 institution, whether public or private, including federal,
6 state, and local departments, agencies, and instrumentalities,
7 under whose authority a licensed or emergency use vaccine is
8 administered.
9 2. A health care provider shall comply with the requirements
10 of 42 U.S.C. §300aa-25 and 42 U.S.C. §300aa-26, including that
11 the health care provider shall document any adverse event
12 following the vaccination that the patient experiences within
13 eight weeks post-administration and that becomes known to
14 the health care provider, submit the report to the federal
15 food and drug administration vaccine adverse event reporting
16 system, and provide the adult patient, or the parent or legal
17 representative of a minor patient, with a copy of the report.
18 Sec. 2. NEW SECTION. 147.163 Administration of vaccines and
19 immunizations —— required reporting to statewide immunization
20 registry —— licensee discipline.
21 1. A health professional required to be licensed under
22 this chapter who is authorized to administer a vaccination
23 or immunization shall become an enrolled user and report the
24 administration of vaccines and immunizations to the statewide
25 immunization registry.
26 2. For the purposes of this section:
27 a. “Enrolled user” means a user of the registry who has
28 completed an enrollment form that specifies the conditions
29 under which the registry can be accessed and who has been
30 issued an identification code and password by the department.
31 b. “Statewide immunization registry” or “registry” means
32 the database and file server maintained by the department as
33 well as the software application that allows enrolled users to
34 exchange immunization or health screening records.

1 subject to licensee discipline pursuant to section 147.55.
2 Sec. 3. CODE EDITOR DIRECTIVE. The Code editor may
3 designate section 147.163, as enacted in this Act, as a new
4 subchapter within chapter 147, entitled “REQUIRED REPORTING OF
5 ADMINISTRATION OF VACCINES AND IMMUNIZATIONS”.
6 EXPLANATION
7 The inclusion of this explanation does not constitute agreement with
8 the explanation’s substance by the members of the general assembly.
9 This bill relates to the requirements for health care
10 providers and health professionals who administer vaccinations
11 and immunizations.
12 The bill requires all health care providers to comply with
13 the federal requirements applicable to health care providers
14 who administer vaccines, including documenting and reporting
15 any adverse event following the vaccination that the patient
16 experiences within eight weeks post-administration and that
17 becomes known to the health care provider to the federal food
18 and drug administration vaccine adverse event reporting system;
19 and providing to an adult patient, or the parent or legal
20 representative of a minor patient, a copy of the report.
21 The bill also requires all licensed health professionals
22 authorized to administer vaccinations or immunizations to be
23 enrolled users of the statewide immunization registry and
24 report such administration to the statewide immunization
25 registry. A health professional who violates this provision is
26 subject to licensee discipline.
