1 An Act requiring the department of human services to allow
2 certain licensed physicians to perform physical examinations
3 required for personnel and children in child care
4 facilities.

1 Section 1. Section 237A.12, Code 2021, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 6. Rules adopted relating to physical
4 examination requirements for licensed or registered facility
5 personnel and the children being provided child care by the
6 licensed or registered facility shall allow for any licensed
7 physician as defined in section 135.1 to perform the physical
8 examination.
9 EXPLANATION
10 The inclusion of this explanation does not constitute agreement with
11 the explanation’s substance by the members of the general assembly.
12 This bill requires the department of human services to allow
13 certain licensed physicians to perform physical examinations
14 required for personnel and children in child care facilities.
15 The bill requires the department of human services to
16 allow any person licensed to practice medicine and surgery,
17 osteopathic medicine and surgery, chiropractic, podiatry, or
18 optometry under the laws of this state to perform physical
19 examinations required for personnel and children in child care
20 facilities. Under current rules, child care center facility
21 personnel, children attending a child care center, and child
22 development home personnel must be examined by a licensed
23 medical doctor, doctor of osteopathy, physician assistant, or
24 advanced registered nurse practitioner, and children attending
25 a child development home must be examined by a licensed
26 physician or a designee in a clinic supervised by a licensed
27 physician. Code section 237A.1 defines a child care facility
28 as a child care center, a preschool, or registered child
29 development home.
