A BILL FOR
1 An Act relating to reports prepared by a chief medical officer,
2 licensed physician, or a mental health professional
3 concerning the hospitalization of a person with a mental
4 illness.
5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 229.1, Code 2021, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 17A. “Report”, when used in reference to
4 a document prepared by a chief medical officer, chief officer
5 of a federal facility, licensed physician, or mental health
6 professional, means a medical recommendation that may also
7 contain a patient’s medical information including but not
8 limited to the patient’s condition, prognosis, and care plan.
9 EXPLANATION
10 The inclusion of this explanation does not constitute agreement with
11 the explanation’s substance by the members of the general assembly.
12 This bill relates to reports prepared by a chief medical
13 officer, licensed physician, or a mental health professional
14 concerning the hospitalization of a person with a mental
15 illness.
16 The bill defines “report”, for the purposes of Code chapter
17 229 (hospitalization of persons with mental health), when used
18 in reference to a document prepared by a chief medical officer,
19 chief officer of a federal facility, licensed physician, or
20 mental health professional, as a medical recommendation that
21 may also contain a patient’s medical information including but
22 not limited to the patient’s condition, prognosis, and care
23 plan.
