1 An Act providing for the reclamation or drainage abatement of
2 lead mines.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 207.21, subsection 1, Code 2021, is
2 amended to read as follows:
3 1. a. The division shall participate in the abandoned
4 mine reclamation program under Pub. L. No. 95-87, Tit. IV,
5 codified at 30 U.S.C. ch. 25, subch. IV. There is established
6 an abandoned mine reclamation fund under the control of the
7 division.
8 b. The division shall also provide for the reclamation or
9 drainage abatement of lead mines as provided in this section
10 which shall be supported by moneys appropriated by federal
11 sources, if available.
12 Sec. 2. Section 207.21, subsection 2, paragraph a,
13 subparagraph (1), Code 2021, is amended to read as follows:
14 (1) Lands which were mined for coal or lead or affected by
15 such mining, waste banks, coal or lead processing, or other
16 coal or lead mining processes, and abandoned or left in an
17 inadequate reclamation status prior to August 3, 1977, and for
18 which there is no continuing reclamation responsibility under
19 state or federal laws.
20 EXPLANATION
21 The inclusion of this explanation does not constitute agreement with
22 the explanation’s substance by the members of the general assembly.
23 This bill amends provisions in Code section 207.21, which
24 provides for an abandoned coal mine reclamation program
25 supported by an abandoned mine reclamation fund administered
26 by the division of soil conservation and water quality of
27 the department of agriculture and land stewardship. The
28 bill requires the division to provide for the reclamation or
29 drainage abatement of lead mines and allows the division to
30 expend available federal moneys for that purpose.
