A BILL FOR
1 An Act relating to online learning and continuous remote
2 learning, and allowing certain school districts or
3 accredited nonpublic schools to deliver coursework using an
4 online learning platform for up to five school days when
5 inclement weather or other unanticipated circumstance causes
6 schools to temporarily close.
7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 279.10, Code 2021, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 4. a. Except as otherwise provided in
4 this subsection or in accordance with a proclamation of public
5 health disaster emergency issued by the governor pursuant to
6 section 29C.6, a school district or accredited nonpublic school
7 shall not offer online learning as defined in section 256.2
8 or continuous remote learning unless the school district or
9 accredited nonpublic school meets the requirements of section
10 256.7, subsection 32, or section 256.11, subsection 17, as
11 appropriate.
12 b. A school district or accredited nonpublic school may,
13 for up to five school days when inclement weather or other
14 unanticipated circumstance causes the school district or
15 accredited nonpublic school to temporarily close school during
16 the regular school calendar, deliver the regular school day
17 coursework using an online learning platform that meets the
18 requirements of section 256.7, subsection 32, or section
19 256.11, subsection 17, as appropriate.
20 c. The limitation on the number of school days specified in
21 paragraph “b” does not apply to a school district that provides
22 educational instruction and course content primarily over the
23 internet in accordance with section 256.7, subsection 32,
24 paragraph “c”, Code 2016, or section 256.9, subsection 55.
25 d. Unless otherwise required by a state or federal law
26 related to students with disabilities, or in accordance with
27 a proclamation of public health disaster emergency issued by
28 the governor pursuant to section 29C.6, this subsection shall
29 not be construed to require a school district or accredited
30 nonpublic school to offer continuous remote learning, to
31 maintain a program of continuous remote learning, to deliver
32 instruction primarily over the internet, to continue delivering
33 instruction primarily over the internet, or to become or remain
34 an approved provider of online learning.
