2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 147.115 Hysterectomy —— consent.
2 1. A woman who is eighteen years of age or older or who has
3 attained majority as provided in section 599.1 shall have legal
4 capacity to provide informed consent to a hysterectomy.
5 2. A person licensed or certified to practice a profession
6 shall not condition the provision of medical care or services
7 to a woman for a hysterectomy on the obtaining of consent to
8 the hysterectomy from any other person including the woman’s
9 spouse.
10 EXPLANATION
11 The inclusion of this explanation does not constitute agreement with
12 the explanation’s substance by the members of the general assembly.
13 This bill relates to consent to a hysterectomy. The bill
14 provides that a woman who is 18 years of age or older or who
15 has attained majority by marriage shall have legal capacity to
16 provide informed consent to a hysterectomy. Additionally, a
17 health care professional shall not condition the provision of
18 medical care or services to a woman for a hysterectomy on the
19 obtaining of consent to the hysterectomy from any other person
20 including the woman’s spouse.
