1 An Act relating to tracking deer on private property at night,
2 and providing penalties.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 481A.125B Tracking deer at night
2 —— entering private property.
3 A person tracking deer at night shall not enter another
4 person’s private property without first receiving permission
5 from the property owner. Failure to receive permission
6 prior to entering the private property constitutes a simple
7 misdemeanor. Additionally, a person who violates this section
8 shall be subject to civil damages as provided in sections
9 481A.130 and 481A.131. A deer taken in violation of this
10 section shall be subject to seizure as provided in section
11 481A.12. This section does not prohibit the unarmed pursuit
12 of deer by a person who lawfully injured or killed a deer that
13 comes to rest on or escapes to the property of another.
14 EXPLANATION
15 The inclusion of this explanation does not constitute agreement with
16 the explanation’s substance by the members of the general assembly.
17 This bill relates to entering private property when tracking
18 deer at night.
19 Under the bill, a person tracking deer at night shall
20 not enter the property of another without first receiving
21 the property owner’s permission. A person who violates the
22 provisions of the bill commits a simple misdemeanor. A simple
23 misdemeanor is punishable by confinement for no more than 30
24 days and a fine of at least $105 but not more than $855. In
25 addition, a person who violates the provisions of the bill is
26 subject to existing civil damages in Code chapter 481A relating
27 to unlawfully taking a deer. A deer taken by a person while the
28 person is violating the provisions of the bill is subject to
29 seizure by the director of the department of natural resources
30 or a peace officer.
31 The bill does not prohibit the unarmed pursuit of deer by a
32 person who lawfully injured or killed a deer that comes to rest
33 on or escapes to the property of another.
