1 An Act relating to the bona fide retirement of a substitute
2 teacher under the Iowa public employees’ retirement system.

1 Section 1. Section 97B.52A, subsection 1, paragraph c,
2 subparagraph (2), Code 2021, is amended by adding the following
3 new subparagraph division:
4 NEW SUBPARAGRAPH DIVISION. (d) For a member whose first
5 month of entitlement is July 2021 or later, covered employment
6 does not include employment as a substitute teacher.
7 EXPLANATION
8 The inclusion of this explanation does not constitute agreement with
9 the explanation’s substance by the members of the general assembly.
10 This bill relates to the bona fide retirement of a substitute
11 teacher under the Iowa public employees’ retirement system
12 (IPERS). Current law provides that a member has a bona fide
13 retirement for purposes of IPERS when, among other things,
14 the member does not return to covered employment until the
15 member has qualified for no fewer than four calendar months
16 of retirement benefits. The bill establishes that, for
17 purposes of this provision, covered employment does not include
18 employment as a substitute teacher. The bill does not modify
19 the requirement that the member not return to any employment
20 with a covered employer until the member has qualified for at
21 least one calendar month of retirement benefits.
