1 An Act relating to reimbursement rates for health care services
2 provided to covered persons by telehealth, and including
3 retroactive applicability provisions.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 514C.34, subsection 1, Code 2021, is
2 amended by adding the following new paragraphs:
3 NEW PARAGRAPH. 0a. “Covered person” means the same as
4 defined in section 514J.102.
5 NEW PARAGRAPH. 00a. “Facility” means the same as defined in
6 section 514J.102.
7 NEW PARAGRAPH. 0c. “Health carrier” means the same as
8 defined in section 514J.102.
9 Sec. 2. Section 514C.34, subsection 1, paragraph c, Code
10 2021, is amended to read as follows:
11 c. “Telehealth” means the delivery of health care
12 services through the use of interactive audio and video,
13 or other electronic media, regardless of where the health
14 care professional and the covered person are each located.
15 “Telehealth” does not include the delivery of health care
16 services delivered solely through an audio-only telephone,
17 electronic mail message, or facsimile transmission.
18 Sec. 3. Section 514C.34, Code 2021, is amended by adding the
19 following new subsection:
20 NEW SUBSECTION. 3A. A health carrier shall reimburse
21 a health care professional and a facility for health care
22 services provided to a covered person by telehealth on the same
23 basis and at the same rate as the health carrier would apply to
24 the same health care services provided to a covered person by
25 the health care professional and the facility in person.
26 Sec. 4. RETROACTIVE APPLICABILITY. This Act applies
27 retroactively to health care services provided by a health care
28 professional or a facility to a covered person by telehealth on
29 or after January 1, 2021.
30 EXPLANATION
31 The inclusion of this explanation does not constitute agreement with
32 the explanation’s substance by the members of the general assembly.
33 This bill requires a health carrier to reimburse a health
34 care professional or facility for health care services provided
35 to a covered person by telehealth on or after January 1, 2021,

1 on the same basis and at the same rate as the health carrier
2 would apply to the same health care services provided to the
3 covered person by the health care professional or facility in
4 person.
