3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 8D.11, Code 2021, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 5. Pursuant to an agreement between the
4 commission and an authorized user, the commission may provide
5 billing services on behalf of the authorized user and charge
6 another entity that receives services from the authorized user
7 pursuant to the network if all of the following conditions are
8 satisfied:
9 a. The services provided by the authorized user to the other
10 entity must be consistent with the mission of the authorized
11 user.
12 b. The services provided by the authorized user to the other
13 entity must be consistent with the requirements and limitations
14 in subsection 2.
15 EXPLANATION
16 The inclusion of this explanation does not constitute agreement with
17 the explanation’s substance by the members of the general assembly.
18 This bill relates to the services provided by the Iowa
19 telecommunications and technology commission. The bill
20 provides that, pursuant to an agreement between the commission
21 and an authorized user, the commission may provide billing
22 services on behalf of the authorized user and charge another
23 entity that receives services from the authorized user pursuant
24 to the Iowa communications network, provided two conditions
25 are satisfied. The services provided by the authorized
26 user to the other entity must be consistent with the mission
27 of the authorized user, and the services provided by the
28 authorized user to the other entity must be consistent with the
29 requirements and limitations in Code section 8D.11, subsection
30 2.
31 Code section 8D.11, subsection 2, provides that neither
32 public nor private agencies shall provide communications
33 services of the network to another entity unless otherwise
34 authorized pursuant to Code chapter 8D.
