1 An Act providing a rebate on the renewal of certain licenses or
2 permits for the sale of alcoholic beverages for on-premises
3 consumption and including effective date provisions.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. ALCOHOLIC BEVERAGES —— REBATE FOR RENEWAL OF
2 LICENSE OR PERMIT FOR ON-PREMISES CONSUMPTION.
3 1. The alcoholic beverages division of the department
4 of commerce shall provide the holder of an annual license
5 or annual permit to sell alcoholic beverages, as defined in
6 section 123.3, for on-premises consumption who renewed such
7 license or permit in the calendar year beginning January 1,
8 2020, a rebate on the renewal fee for such license or permit if
9 the holder renews the permit or license in the calendar year
10 beginning January 1, 2021. The rebate shall be equal to the
11 renewal fee amount the holder paid in the previous calendar
12 year, reduced by the amount of any reimbursement or reduction
13 of such fee provided to the holder pursuant to a proclamation
14 of disaster emergency pursuant to section 29C.6 or other action
15 of the state.
16 2. If the holder paid such a renewal fee in the calendar
17 year beginning January 1, 2021, prior to the effective date of
18 this Act, the alcoholic beverages division shall provide the
19 holder with a refund in the amount of the rebate to which the
20 holder would otherwise have been entitled under this section.
21 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate
22 importance, takes effect upon enactment.
23 EXPLANATION
24 The inclusion of this explanation does not constitute agreement with
25 the explanation’s substance by the members of the general assembly.
26 This bill requires the alcoholic beverages division of the
27 department of commerce to provide the holder of an annual
28 license or annual permit to sell alcoholic beverages for
29 on-premises consumption who renewed such license or permit in
30 the calendar year beginning January 1, 2020, a rebate on the
31 renewal fee for such license or permit if the holder renews the
32 permit or license in the calendar year beginning January 1,
33 2021. The rebate shall be equal to the renewal fee amount the
34 holder paid in the previous calendar year.
35 If the holder paid such a renewal fee in the calendar year

1 beginning January 1, 2021, prior to the effective date of the
2 bill, the division shall provide the holder with a refund in
3 the amount of the rebate to which the holder would otherwise
4 have been entitled under the bill.
5 The bill takes effect upon enactment.
