3 including effective date provisions.

1 Section 1. ADJUSTMENT OF OVERPAYMENT OF CLAIM —— LIMITED
2 TIME FRAME. Notwithstanding any provision of law to the
3 contrary, if the Medicaid program, including any managed care
4 organization contracting with the state to pay providers for
5 the cost of medical services received by Medicaid members,
6 discovers an overpayment to a provider that does not involve
7 fraud or misrepresentation, the provider shall not be subject
8 to repayment of the overpayment or to offset against future
9 reimbursement of claims by the provider if twelve months or
10 more have elapsed since such overpayment was made.
11 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate
12 importance, takes effect upon enactment.
13 EXPLANATION
14 The inclusion of this explanation does not constitute agreement with
15 the explanation’s substance by the members of the general assembly.
16 This bill provides that notwithstanding any provision of law
17 to the contrary, if the Medicaid program, including any managed
18 care organization contracting with the state to pay providers
19 for the cost of medical services received by Medicaid members,
20 discovers an overpayment to a provider, the provider shall not
21 be subject to repayment of the overpayment or to offset against
22 future reimbursement of claims by the provider if 12 months or
23 more have elapsed since the overpayment was made. The bill
24 takes effect upon enactment.
