1 Section 1. MEDICAID MANAGED CARE —— PARTICIPATING
2 PHARMACIES AND PHARMACISTS. A Medicaid managed care
3 organization shall accept as a participating network provider
4 any licensed pharmacy or pharmacist located within the
5 geographic service area of the managed care organization if
6 the licensed pharmacy or pharmacist agrees to comply with the
7 terms and conditions for participation in the managed care
8 organization’s network, meets and agrees to the conditions
9 for participation in the Medicaid program established by the
10 department of human services, accepts the prevailing Medicaid
11 reimbursement, and is subject to license discipline pursuant to
12 section 155A.12 or 155A.15, as applicable.
13 EXPLANATION
14 The inclusion of this explanation does not constitute agreement with
15 the explanation’s substance by the members of the general assembly.
16 This bill requires a Medicaid managed care organization
17 to accept as a participating network provider any licensed
18 pharmacy or pharmacist located within the geographic service
19 area of the managed care organization if the licensed pharmacy
20 or pharmacist agrees to comply with the terms and conditions
21 for participation in the managed care organization’s network,
22 meets and agrees to the conditions for participation in
23 the Medicaid program established by the department of human
24 services, accepts the prevailing Medicaid reimbursement, and is
25 subject to license discipline.
