3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 256.69, Code 2021, is amended to read as
2 follows:
3 256.69 Local financial support.
4 1. Commencing July 1, 1977, each city within its corporate
5 boundaries and each county within the unincorporated area of
6 the county shall levy a tax of at least six and three-fourths
7 cents per thousand dollars of assessed value on the taxable
8 property or at least the monetary equivalent thereof when all
9 or a portion of the funds are obtained from a source other than
10 taxation, for the purpose of providing financial support to
11 the public library which provides library services within the
12 respective jurisdictions.
13 2. A library receiving financial support from taxes or
14 sources under subsection 1 shall not prohibit the use of the
15 library or deny services offered by the library to any person
16 residing in an area where the minimum tax is levied and paid or
17 an area from where the minimum monetary equivalent is provided.
18 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate
19 importance, takes effect upon enactment.
20 EXPLANATION
21 The inclusion of this explanation does not constitute agreement with
22 the explanation’s substance by the members of the general assembly.
23 Code section 256.69 provides that each city within its
24 corporate boundaries and each county within the unincorporated
25 area of the county shall levy a tax of at least 6 3/4th
26 cents per $1,000 of assessed value or at least the monetary
27 equivalent thereof when all or a portion of the funds are
28 obtained from a source other than taxation for the purpose
29 of providing financial support to the public library which
30 provides library services within the respective jurisdictions.
31 This bill prohibits a library that is receiving financial
32 support under Code section 256.69 from prohibiting the use of
33 the library or denying services offered by the library to any
34 person residing in an area where the minimum tax is levied and
35 paid or an area from where the minimum monetary equivalent is
