1 An Act relating to the use of moneys in the grants to counties
2 program for lead and copper testing in water supply systems.

1 Section 1. Section 455E.11, subsection 2, paragraph
2 b, subparagraph (2), subparagraph division (b), unnumbered
3 paragraph 1, Code 2021, is amended to read as follows:
4 Two percent is appropriated annually to the department and,
5 except for administrative expenses, is transferred to the Iowa
6 department of public health for the purpose of administering
7 grants to counties and conducting oversight of county-based
8 programs for the testing of private rural water supply wells,
9 private rural water supply well sealing, and the proper closure
10 of private rural abandoned wells and cisterns, and testing
11 water supply systems, as defined in section 455B.211, for
12 the existence of lead and copper. Not more than thirty-five
13 percent of the moneys is appropriated annually for grants to
14 counties for the purpose of conducting programs of private
15 rural water supply testing, private rural water supply well
16 sealing, the proper closure of private rural abandoned wells
17 and cisterns, water supply system testing for the existence
18 of lead and copper, or any combination thereof. An amount
19 agreed to by the department of natural resources and the Iowa
20 department of public health shall be retained by the department
21 of natural resources for administrative expenses.
22 Sec. 2. Section 455E.11, subsection 2, paragraph b,
23 subparagraph (2), subparagraph division (b), subparagraph
24 subdivision (i), Code 2021, is amended to read as follows:
25 (i) A county applying for grants under this subparagraph
26 division shall submit only one application. To be eligible for
27 a grant, a county must have adopted standards for private water
28 supply and private disposal facilities at least as stringent as
29 the standards adopted by the commission. During each fiscal
30 year, the amount granted each eligible applicant shall be
31 the total funds available divided by the number of eligible
32 counties applying. Upon receipt of the grant, the county may
33 apply the funds to any one or more of the county-based programs
34 for the testing of private rural water supply wells, private
35 rural water supply well sealing, and the proper closure of

1 private rural abandoned wells and cisterns, and testing water
2 supply systems for the existence of lead and copper.
3 EXPLANATION
4 The inclusion of this explanation does not constitute agreement with
5 the explanation’s substance by the members of the general assembly.
6 Under current law, moneys in the groundwater protection fund
7 are used for purposes related to groundwater monitoring and
8 groundwater quality standards. The agricultural management
9 account consists of moneys deposited in the account from the
10 collection of fertilizer inspection fees, pesticide dealer
11 license fees, pesticide registration fees, and other moneys
12 designated for the purpose of agricultural management. After
13 an appropriation of $9,000 to the Iowa department of public
14 health, 2 percent of the remaining moneys is appropriated
15 to the department of natural resources (DNR) and, excluding
16 administrative expenses for the DNR, transferred to the
17 Iowa department of public health (DPH) for the purpose of
18 administering grants to counties and conducting oversight of
19 county-based programs related to private well testing, sealing,
20 and closure.
21 This bill allows DPH to use moneys appropriated to the
22 grants to counties program for testing water supply systems for
23 the existence of lead and copper. For purposes of the bill,
24 “water supply system” means the system of pipes, structures,
25 and facilities through which a public water supply is obtained,
26 treated, and sold or distributed for human consumption or
27 household use.
