3 institutions for mental diseases.

1 Section 1. MEDICAID DEMONSTRATION WAIVER —— MENTAL HEALTH
2 SERVICES —— INSTITUTIONS FOR MENTAL DISEASES. The department
3 of human services shall submit a Medicaid 1115 demonstration
4 waiver application to the centers for Medicare and Medicaid
5 services of the United States department of health and human
6 services, as described in state Medicaid director letter
7 #18-011, to provide and seek federal financial participation
8 for services for Medicaid members with serious mental illness
9 (SMI) or serious emotional disturbance (SED) during short-term
10 stays for acute care in residential and inpatient settings that
11 qualify as institutions for mental diseases (IMDs) as defined
12 in 42 U.S.C. §1396d(i). The goal of this demonstration waiver
13 is for the state to maintain and enhance access to mental
14 health services and continue delivery system improvements
15 to provide more coordinated and comprehensive treatment
16 of Medicaid members with SMI or SED through both inpatient
17 and residential settings that qualify as IMDs and through
18 community-based mental health care settings. The department
19 shall provide progress reports regarding the approval of the
20 demonstration waiver application to the governor and the
21 general assembly on a quarterly basis.
22 EXPLANATION
23 The inclusion of this explanation does not constitute agreement with
24 the explanation’s substance by the members of the general assembly.
25 This bill requires the department of human services (DHS)
26 to submit a Medicaid 1115 demonstration waiver application to
27 the centers for Medicare and Medicaid services of the United
28 States department of health and human services to provide
29 and seek federal financial participation for services for
30 Medicaid members with serious mental illness (SMI) or serious
31 emotional disturbance (SED) during short-term stays for acute
32 care in residential and inpatient settings that qualify as
33 institutions for mental diseases (IMDs). The goal of this
34 demonstration waiver is for the state to maintain and enhance
35 access to mental health services and continue delivery system

1 improvements to provide more coordinated and comprehensive
2 treatment of Medicaid beneficiaries with SMI or SED through
3 both inpatient and residential settings that qualify as IMDs
