1 An Act relating to chauffeurs and exempting certain persons
2 from the requirement to be licensed as a chauffeur.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 321.1, subsection 8, unnumbered
2 paragraph 1, Code 2021, is amended to read as follows:
3 “Chauffeur” means a person who operates a motor vehicle,
4 including a school bus, in the transportation of persons for
5 wages, compensation, or hire, or a person who operates a truck
6 tractor, road tractor, or a motor truck which has a gross
7 vehicle weight rating exceeding sixteen thousand pounds.
8 Sec. 2. Section 321.1, subsection 8, paragraph b, Code 2021,
9 is amended by striking the paragraph and inserting in lieu
10 thereof the following:
11 b. A fire fighter is not a chauffeur when operating a fire
12 apparatus.
13 Sec. 3. Section 321.1, subsection 8, Code 2021, is amended
14 by adding the following new paragraph:
15 NEW PARAGRAPH. 0c. An ambulance or rescue squad attendant
16 is not a chauffeur when operating an ambulance or rescue squad
17 apparatus.
18 EXPLANATION
19 The inclusion of this explanation does not constitute agreement with
20 the explanation’s substance by the members of the general assembly.
21 Under current law, chauffeurs are subject to special
22 driver’s licensing requirements. A chauffeur is a person
23 who operates a motor vehicle, including a school bus, in the
24 transportation of persons for wages, compensation, or hire, or
25 a person who operates a truck tractor, road tractor, or a motor
26 truck which has a gross vehicle weight rating exceeding 16,000
27 pounds. There are 12 exceptions that specifically exempt
28 certain persons from being considered a chauffeur.
29 This bill eliminates from the definition of chauffeur
30 persons who operate a truck tractor, road tractor, or motor
31 truck which has a gross vehicle weight rating exceeding 16,000
32 pounds. The bill changes the existing exception relating to
33 volunteer fire fighters and volunteer ambulance and rescue
34 squad attendants by eliminating the volunteer requirement
35 and by eliminating the volunteer classification for persons

1 who receive nominal compensation not based upon the value of
2 the service performed. The bill exempts all fire fighters
3 when operating a fire apparatus and all ambulance and rescue
4 squad attendants when operating an ambulance or rescue squad
5 apparatus from being considered a chauffeur.
6 The fee for a chauffeur’s instruction permit is $12 compared
7 to a fee of $6 for an instruction permit other than a special
8 instruction, chauffeur’s instruction, or commercial learner’s
9 permit. The fee for a noncommercial chauffeur driver’s license
10 is $8 per year of validity compared to a fee of $4 per year of
11 validity for noncommercial driver’s licenses.
