A BILL FOR
1 An Act relating to notification of the general assembly
2 concerning certain state government leases and real property
3 acquisitions.

1 Section 1. NEW SECTION. 7E.5B Real property lease or
2 purchase —— notice.
3 In addition to any other provision of law, any purchase or
4 lease of real property, other than on a temporary basis, when
5 necessary in order to implement the programs of an authority or
6 protect the investments of an authority, shall require prior
7 written notice from the authority to the legislative services
8 agency. The legislative services agency shall submit the
9 notification to the government oversight standing committees
10 of the general assembly. The notification shall include the
11 information as described in section 8A.321, subsection 16.
12 Sec. 2. Section 8A.321, Code 2021, is amended by adding the
13 following new subsection:
14 NEW SUBSECTION. 16. At least thirty days prior to entering
15 into a contract for a lease or renewal of a lease pursuant
16 to subsection 6 or a contract for the acquisition of real
17 property pursuant to subsection 9 in which any part or the
18 total amount of the contract is at least fifty thousand
19 dollars, notify the legislative services agency concerning the
20 contract. The legislative services agency shall submit the
21 notification to the general assembly’s standing committees on
22 government oversight. The notification is required regardless
23 of the source of payment for the lease, renewal of lease, or
24 acquisition of real property. The notification shall include
25 all of the following information:
26 a. A description of the buildings and office space subject
27 to the lease or renewal of lease or a description of the real
28 property to be acquired.
29 b. The proposed terms of the contract.
30 c. The cost of the contract, including principal and
31 interest costs. If the actual cost of a contract is not known
32 at least thirty days prior to entering into the contract, the
33 director shall estimate the principal and interest costs for
34 the contract.
35 d. An identification of the means and source of payment of

1 the contract.
2 e. An analysis of consequences of delaying or abandoning the
3 commencement of the contract.
4 EXPLANATION
5 The inclusion of this explanation does not constitute agreement with
6 the explanation’s substance by the members of the general assembly.
7 This bill establishes notice requirements relating to
8 certain leases or purchases of real property by the department
9 of administrative services or executive branch authority.
10 New Code section 7E.5B requires an executive branch
11 authority to provide prior written notice to the legislative
12 services agency for submission to the general assembly’s
13 standing committees on government oversight information for any
14 purchase or lease of real property, other than on a temporary
15 basis, by the authority when necessary in order to implement
16 the programs of the authority. The bill provides that the
17 notification shall include the information as required by the
18 bill for the department of administrative services.
19 Code section 8A.321, concerning managing the physical
20 resources of government, is amended to require the director of
21 the department of administrative services to notify and provide
22 to the legislative services agency for submission to the
23 general assembly’s standing committees on government oversight
24 information regarding entering into a contract for a lease or
25 renewal of a lease for certain buildings and office space or
26 a contract for the acquisition of real property in which any
27 part or the total amount of the contract is at least $50,000.
28 The bill requires the notification at least 30 days prior to
29 entering into a contract and provides that the notification
30 include information describing the buildings and office space
31 subject to the lease or renewal of lease or describing the
32 real property to be acquired, providing the proposed terms of
33 the contract and the cost of the contract, identifying the
34 means and source of payment of the contract, and analyzing the
35 consequences of delaying or abandoning the commencement of the
