1 An Act relating to the compulsory age of attendance and to
2 penalties for failure to attend school.

1 Section 1. Section 299.1A, subsection 1, Code 2021, is
2 amended to read as follows:
3 1. Except as provided in subsections 2 and 3, a child
4 who has reached the age of six and is under sixteen eighteen
5 years of age by September 15 is of compulsory attendance age.
6 However, if a child enrolled in a school district or accredited
7 nonpublic school reaches the age of sixteen eighteen on or
8 after September 15, the child remains of compulsory age until
9 the end of the regular school calendar.
10 Sec. 2. Section 321.213B, Code 2021, is amended to read as
11 follows:
12 321.213B Suspension for failure to attend.
13 1. The department shall establish procedures by rule for
14 suspending the license of a juvenile who has been issued a
15 driver’s license and is not in compliance with the requirements
16 of section 299.1B or issuing the juvenile a restricted license
17 under section 321.178.
18 2. Upon receipt of proof of high school graduation from
19 a person whose intermediate or full driver’s license was
20 suspended or revoked pursuant to section 299.1B, the department
21 may reinstate the person’s license. Notwithstanding section
22 321.191, subsection 8, reinstatement of a driver’s license
23 pursuant to this subsection shall be without fee.
24 Sec. 3. STATE MANDATE FUNDING SPECIFIED. In accordance
25 with section 25B.2, subsection 3, the state cost of requiring
26 compliance with any state mandate included in this Act shall
27 be paid by a school district from state school foundation aid
28 received by the school district under section 257.16. This
29 specification of the payment of the state cost shall be deemed
30 to meet all of the state funding-related requirements of
31 section 25B.2, subsection 3, and no additional state funding
32 shall be necessary for the full implementation of this Act
33 by and enforcement of this Act against all affected school
34 districts.

1 The inclusion of this explanation does not constitute agreement with
2 the explanation’s substance by the members of the general assembly.
3 This bill relates to compulsory education standards and
4 penalties.
5 The bill raises the compulsory school attendance age from 16
6 to 18.
7 The department of transportation is authorized to reinstate
8 a license, without fee, upon receipt of proof of high school
9 graduation from a person whose intermediate or full driver’s
10 license was suspended or revoked because the person was truant,
11 notwithstanding a current Code provision that permits the
12 department to charge a fee of $20 for reinstatement of a
13 license.
14 The bill may include a state mandate as defined in Code
15 section 25B.3. The bill requires that the state cost of
16 any state mandate included in the bill be paid by a school
17 district from state school foundation aid received by the
18 school district under Code section 257.16. The specification
19 is deemed to constitute state compliance with any state mandate
20 funding-related requirements of Code section 25B.2. The
21 inclusion of this specification is intended to reinstate the
22 requirement of political subdivisions to comply with any state
23 mandates included in the bill.
