AN ACT
RELATING TO THE PRACTICE OF PHARMACY, INCLUDING THE
PRESCRIPTION AND ADMINISTRATION OF VACCINES AND
COLLABORATIVE PHARMACY PRACTICE.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 155A.46, subsection 1, paragraph a, Code
2 2021, is amended by adding the following new subparagraph:
3 NEW SUBPARAGRAPH. (7) An immunization or vaccination for
4 C0VID-19 as defined in section 686D.2.
5 Sec. 2. Section 155A.46, subsection 1, Code 2021, is amended
6 by adding the following new paragraph:
7 NEW PARAGRAPH. e. A pharmacist may, pursuant to statewide
8 protocols developed by the board in consultation with the

9 department of public health and consistent with subsection 2,
10 order and administer the following to patients ages six years
11 and older:
12 (1) Point-of-care testing and treatment for influenza,
13 streptococcus A, and COVID-19 as defined in section 686D.2 at
14 the point of interaction between a pharmacist and a patient.
15 (2) Point-of-care testing at the point of interaction
16 between a pharmacist and a patient in response to a public
17 health emergency.
18 Sec. 3. NEW SECTION. 155A.47 Collaborative pharmacy
19 practice —— agreements —— payment.
20 1. For the purposes of this section:
21 a. “Collaborative pharmacy practice” means a practice of
22 pharmacy whereby a pharmacist provides patient care and drug
23 therapy management services not otherwise permitted to be
24 performed by a pharmacist to patients under a collaborative
25 pharmacy practice agreement with another pharmacist or
26 practitioner which defines the nature, scope, conditions, and
27 limitations of the patient care and drug therapy management
28 services to be provided by a pharmacist in order to ensure that
29 a patient achieves the desired outcomes.
30 b. “Health benefit plan” means the same as defined in
31 section 514J.102.
32 c. “Health carrier” means the same as defined in section
33 514J.102.
34 2. Notwithstanding any provision of law to the contrary, a
35 pharmacist may engage in a collaborative pharmacy practice, in
1 accordance with rules adopted by the board pursuant to chapter
2 17A and under a collaborative pharmacy practice agreement, to
3 provide patient care and drug therapy management services to
4 a patient.
5 3. Notwithstanding any provision of a health benefit plan
6 to the contrary, whenever a health benefit plan provides for
7 payment or reimbursement for a service that is within the
8 lawful scope of practice of a practitioner or pharmacist
9 and the service is provided by a pharmacist pursuant to a
10 collaborative pharmacy practice agreement under this section,

11 the health carrier may provide payment or reimbursement for the
12 service.
