A BILL FOR
1 An Act relating to the calculation of education funding
2 for children living in certain facilities and including
3 applicability provisions.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 282.31, subsection 1, paragraph b,
2 subparagraph (2), Code 2021, is amended to read as follows:
3 (2) However, on June 30 of a school year, if the board
4 of directors of a school district determines that the number
5 of days for which a school district generated funding for
6 children under this paragraph “b” who were counted in the
7 basic enrollment of the school district in that school year in
8 accordance with section 257.6, subsection 1, is fewer less than
9 the sum of the number of months days enrolled for all children
10 were enrolled in the school district under this paragraph
11 “b” during the school year divided by nine, the secretary of
12 the school district may submit a claim to the department of
13 education by August 1 following the school year for an amount
14 equal to the district cost per pupil of the district for the
15 previous school year multiplied by the difference between
16 the number of children counted and the number of children
17 calculated by the number of months of enrollment quotient of
18 the excess number of enrolled days for children under this
19 paragraph “b” divided by the number of days in the district’s
20 board-approved calendar for the previous year. The amount of
21 the claim shall be paid by the department of administrative
22 services to the school district by October 1. The department
23 of administrative services shall transfer the total amount
24 of the approved claim of a school district from the moneys
25 appropriated under section 257.16 and the amount paid shall
26 be deducted monthly from the state foundation aid paid to all
27 school districts in the state during the remainder of the
28 subsequent fiscal year in the manner provided in paragraph “a”.
29 Sec. 2. APPLICABILITY. This Act applies to school budget
30 years beginning on or after July 1, 2021.
31 EXPLANATION
32 The inclusion of this explanation does not constitute agreement with
33 the explanation’s substance by the members of the general assembly.
34 This bill modifies the methodology used to calculate the
35 amount of funding a school district may request from the

1 department of education for providing services to certain
2 children living in an approved or licensed shelter care home or
3 an approved juvenile detention home, and by operation of law
4 children living in certain residential treatment facilities,
5 a psychiatric unit or institution, or in a child foster care
6 facility or placement.
7 The current law methodology uses, in part, a calculation
8 based on the number of months children were enrolled in the
9 district. The bill changes the calculation to be, in part,
10 based on the number of days children are enrolled in the
11 district.
12 The bill applies to school budget years beginning on or after
13 July 1, 2021.
