1 An Act relating to the number of children receiving child care
2 at any one time in a child care home.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 237A.1, subsections 6 and 7, Code 2021,
2 are amended to read as follows:
3 6. “Child care home” means a person or program providing
4 child care to five or fewer any of the following children at
5 any one time that is not registered to provide child care under
6 this chapter, as authorized under section 237A.3.:
7 a. Five or fewer children.
8 b. Six or fewer children, if at least one of the children
9 is school-aged.
10 7. “Child development home” means a person or program
11 registered under section 237A.3A that may provide child care to
12 six seven or more children at any one time.
13 Sec. 2. Section 237A.3, subsection 1, Code 2021, is amended
14 to read as follows:
15 1. A person or program providing child care to five children
16 or fewer at any one time is a in a child care home provider and
17 is not required to register under section 237A.3A as a child
18 development home. However, the person or program may register
19 as a child development home.
20 EXPLANATION
21 The inclusion of this explanation does not constitute agreement with
22 the explanation’s substance by the members of the general assembly.
23 This bill relates to the number of children receiving child
24 care at any one time in a child care home.
25 The bill allows a person or program providing child care in
26 a child care home to care for five or fewer children or six or
27 fewer children if at least one of the children is school-aged.
28 Current law requires a child care home to register as a child
29 development home if the child care home provides child care to
30 more than five children at any one time.
31 The bill makes conforming Code changes including a change to
32 the definition of “child development home”.
