AN ACT
RELATING TO ALCOHOL BEVERAGE CONTROL CONCERNING CERTAIN CLASS
“C” LIQUOR CONTROL LICENSES, HOURS OF SALE OF ALCOHOLIC
BEVERAGES ON SUNDAY, AND THE DELIVERY OF CERTAIN ALCOHOLIC
BEVERAGES.
5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 123.3, subsection 11, Code 2021, is
2 amended to read as follows:
3 11. “Canned cocktail” means a mixed drink or cocktail that
4 is premixed and packaged in a metal can and contains more than
5 six and twenty-five hundredths percent of alcohol by volume but
6 not more than fifteen percent of alcohol by volume. A mixed
7 drink or cocktail mixed and packaged in a metal can pursuant to
8 section 123.49, subsection 2, paragraph “d”, subparagraph (3),
9 shall not be considered a canned cocktail.
10 Sec. 2. Section 123.30, subsection 3, paragraph c,
11 subparagraph (1), Code 2021, is amended to read as follows:
12 (1) A class “C” liquor control license may be issued to
13 a commercial establishment but must be issued in the name of
14 the individuals who actually own the entire business and shall
15 authorize the holder to purchase alcoholic liquors in original
16 unopened containers from class “E” liquor control licensees
17 only, wine from class “A” wine permittees or class “B” wine
18 permittees who also hold class “E” liquor control licenses
19 only as provided in sections 123.173 and 123.177, and to sell
20 alcoholic beverages to patrons by the individual drink for

21 consumption on the premises only. However, alcoholic liquor,
22 wine, and beer in original unopened containers may also be sold
23 for consumption off the premises. In addition, mixed drinks
24 or cocktails may also be sold for consumption off the premises
25 subject to the requirements of section 123.49, subsection 2,
26 paragraph “d”. The holder of a class “C” liquor control license
27 may also hold a special class “A” beer permit for the premises
28 licensed under a class “C” liquor control license for the
29 purpose of operating a brewpub pursuant to this chapter.
30 Sec. 3. Section 123.36, subsection 6, Code 2021, is amended
31 to read as follows:
32 6. Any club, hotel, motel, native distillery,
33 passenger-carrying boat or ship, railway corporation, air
34 common carrier, or commercial establishment holding a liquor
35 control license, subject to section 123.49, subsection 2,
1 paragraph “b”, may apply for and receive permission to sell and
2 dispense alcoholic beverages as authorized by section 123.30 to
3 patrons between the hours of 8:00 6:00 a.m. on Sunday and 2:00
4 a.m. on the following Monday. For the privilege of selling
5 beer, wine, and alcoholic liquor on the premises on Sunday the
6 liquor control license fee of the applicant shall be increased
7 by twenty percent of the regular fee prescribed for the license
8 pursuant to this section, and the privilege shall be noted on
9 the liquor control license.
10 Sec. 4. Section 123.46A, subsections 1 and 2, Code 2021, are
11 amended to read as follows:
12 1. Licensees and permittees authorized to sell alcoholic
13 liquor, wine, or beer in original unopened containers for
14 consumption off the licensed premises may deliver alcoholic
15 liquor, wine, or beer to a home, another licensed premises if
16 there is identical ownership of the premises by the licensee
17 or permittee, or other designated location in this state.
18 Deliveries shall be limited to alcoholic beverages authorized
19 by the licensee’s or permittee’s license or permit. Orders
20 delivered to another licensed premises shall contain only those
21 alcoholic beverages authorized for sale by the liquor control
22 license or retail wine or beer permit covering the premises
23 to which the alcoholic beverages will be delivered. Orders
24 delivered to another licensed premises shall be fulfilled using

25 the alcoholic beverages inventory owned by the licensee or
26 permittee who will receive the order for delivery. If the
27 recipient refuses or fails to pick up the delivery, or is
28 ineligible to receive the delivery, the alcoholic beverages
29 shall be returned to the licensee or permittee who fulfilled
30 the order.
31 2. All deliveries of alcoholic liquor, wine, or beer, or
32 mixed drinks or cocktails shall be subject to the following
33 requirements and restrictions:
34 a. Payment for the alcoholic liquor, wine, or beer, or
35 mixed drinks or cocktails shall be received by the licensee or
1 permittee at the time of order.
2 b. Orders for deliveries may be taken by the licensee or
3 permittee between the hours of 2:00 a.m. and 6:00 a.m. on
4 a day other than Sunday, and orders for deliveries may be
5 taken between the hours of 2:00 a.m. and 8:00 6:00 a.m. on a
6 Sunday provided the licensee or permittee has been granted the
7 privilege of selling alcoholic liquor, wine, or beer, or mixed
8 drinks or cocktails on Sunday, notwithstanding any provision of
9 section 123.49, subsection 2, paragraph “b”, to the contrary.
10 c. Alcoholic liquor, wine, or beer, or mixed drinks or
11 cocktails delivered to a person shall be for personal use and
12 not for resale.
13 d. Deliveries shall only be made to persons in this state
14 who are twenty-one years of age or older.
15 e. Deliveries shall not be made to a person who is
16 intoxicated or is simulating intoxication.
17 f. Deliveries shall occur between 6:00 a.m. and 10:00 p.m.
18 Monday through Saturday, and between 8:00 a.m. and 10:00 p.m.
19 Sunday.
20 g. Delivery of alcoholic liquor, wine, or beer, or mixed
21 drinks or cocktails shall be made by the licensee or permittee,
22 or the licensee’s or permittee’s employee, and not by a third
23 party.
24 h. Delivery personnel shall be twenty-one years of age or
25 older.
26 i. Deliveries shall be made in a vehicle owned, leased, or
27 under the control of the licensee or permittee.
28 j. Valid proof of the recipient’s identity and age shall

29 be obtained at the time of delivery, and the signature of a
30 person twenty-one years of age or older shall be obtained as a
31 condition of delivery.
32 k. Licensees and permittees shall maintain records
33 of deliveries which include the quantity delivered, the
34 recipient’s name and address, and the signature of the
35 recipient of the alcoholic liquor, wine, or beer, or mixed
1 drinks or cocktails. The records shall be maintained on the
2 licensed premises for a period of three years.
3 l. Orders delivered to another licensed premises shall
4 contain only those alcoholic beverages authorized for sale
5 by the liquor control license or retail wine or beer permit
6 covering the premises to receive the delivery.
7 m. Orders delivered to another licensed premises shall be
8 fulfilled using the alcoholic beverages inventory owned by the
9 licensee or permittee who received the order for delivery. If
10 the recipient refuses or fails to pick up the delivery, or is
11 ineligible to receive the delivery, the alcoholic beverages
12 shall be returned to the licensee or permittee who fulfilled
13 the order.
14 Sec. 5. Section 123.46A, Code 2021, is amended by adding the
15 following new subsection:
16 NEW SUBSECTION. 1A. Licensees and permittees authorized to
17 sell wine, beer, or mixed drinks or cocktails for consumption
18 off the licensed premises in a container other than the
19 original container may deliver the wine, beer, or mixed drinks
20 or cocktails to a home or other designated location in this
21 state only if the container other than the original container
22 has been sold and securely sealed in compliance with this
23 chapter or the rules of the division. Deliveries shall be
24 limited to alcoholic beverages authorized by the licensee’s or
25 permittee’s license or permit.
26 Sec. 6. Section 123.49, subsection 2, paragraph b, Code
27 2021, is amended to read as follows:
28 b. Sell or dispense any alcoholic beverage on the premises
29 covered by the license or permit, or permit its consumption
30 thereon between the hours of 2:00 a.m. and 6:00 a.m. on a
31 weekday, and between the hours of 2:00 a.m. on Sunday and 6:00
32 a.m. on the following Monday, however, a holder of a liquor

33 control license or retail wine or beer permit granted the
34 privilege of selling alcoholic liquor, wine, or beer on Sunday
35 may sell or dispense alcoholic liquor, wine, or beer between
1 the hours of 8:00 6:00 a.m. on Sunday and 2:00 a.m. on the
2 following Monday.
3 Sec. 7. Section 123.49, subsection 2, paragraph d,
4 subparagraphs (2) and (3), Code 2021, are amended to read as
5 follows:
6 (2) Mixed drinks or cocktails mixed on the premises that are
7 not for immediate consumption may be consumed on the licensed
8 premises subject to the requirements of this subparagraph
9 pursuant to rules adopted by the division. The rules shall
10 provide that the mixed drinks or cocktails be stored, for
11 no longer than seventy-two hours, in a labeled container in
12 a quantity that does not exceed three gallons. The rules
13 shall also provide that added flavors and other nonbeverage
14 ingredients included in the mixed drinks or cocktails shall
15 not include hallucinogenic substances or added caffeine or
16 other added stimulants including but not limited to guarana,
17 ginseng, and taurine. In addition, the The rules shall also
18 require that the licensee keep records as to when the contents
19 in a particular container were mixed and the recipe used for
20 that mixture. In addition, mixed drinks or cocktails mixed
21 on the premises pursuant to this subparagraph may be sold
22 for consumption off the licensed premises as provided in and
23 subject to the requirements of subparagraph (3).
24 (3) Mixed drinks or cocktails mixed on premises covered
25 by a class “C” liquor control license or a class “C” native
26 distilled spirits liquor control license for consumption
27 off the licensed premises may be sold if the mixed drink or
28 cocktail is immediately sealed with a lid or other method
29 of securing the product filled in a sealed container and is
30 promptly taken from the licensed premises prior to consumption
31 of the mixed drink or cocktail. A mixed drink or cocktail
32 that is sold and sealed in a sealed container in compliance
33 with the requirements of this subparagraph and rules adopted
34 by the division shall not be deemed an open container subject
35 to the requirements of sections 321.284 and 321.284A if the
1 sealed container is unopened and the seal has not been tampered

2 with, and the contents of the container have not been partially
3 removed.
4 Sec. 8. Section 123.49, subsection 2, paragraph d, Code
5 2021, is amended by adding the following new subparagraph:
6 NEW SUBPARAGRAPH. (4) For purposes of this paragraph:
7 (a) “Sealed container” means a vessel, including a
8 substantial or sturdy plastic container and a vacuum or
9 heat-sealed pouch, containing a mixed drink or cocktail
10 that is designed to prevent consumption without removal of
11 a tamper-evident lid, cap, or seal. “Sealed container” does
12 not include a container with a sipping hole or other opening
13 for a straw, unless the hole or other opening includes a
14 tamper-evident seal, but a straw may be separately provided
15 with a sealed container to the consumer for off-premises
16 consumption.
17 (b) “Tamper-evident” means a lid, cap, or seal that visibly
18 demonstrates when a container has been opened.
19 Sec. 9. Section 123.134, subsection 4, Code 2021, is amended
20 to read as follows:
21 4. Any club, hotel, motel, or commercial establishment
22 holding a class “B” beer permit, subject to the provisions of
23 section 123.49, subsection 2, paragraph “b”, may apply for
24 and receive permission to sell and dispense beer to patrons
25 on Sunday for consumption on or off the premises between
26 the hours of 8:00 6:00 a.m. on Sunday and 2:00 a.m. on the
27 following Monday. Any class “C” beer permittee may sell beer
28 for consumption off the premises between the hours of 8:00 6:00
29 a.m. on Sunday and 2:00 a.m. on the following Monday. For the
30 privilege of selling beer on Sunday the beer permit fees of the
31 applicant shall be increased by twenty percent of the regular
32 fees prescribed for the permit pursuant to this section and the
33 privilege shall be noted on the beer permit.
34 Sec. 10. Section 123.150, Code 2021, is amended to read as
35 follows:
1 123.150 Sunday sales before New Year’s Day.
2 Notwithstanding section 123.36, subsection 6, section
3 123.49, subsection 2, paragraph “b”, and section 123.134,
4 subsection 4, a holder of any class of liquor control license
5 or the holder of a class “B” beer permit may sell or dispense

6 alcoholic liquor, wine, or beer to patrons for consumption on
7 the premises between the hours of 8:00 6:00 a.m. on Sunday and
8 2:00 a.m. on Monday when that Monday is New Year’s Day and beer
9 for consumption off the premises between the hours of 8:00 6:00
10 a.m. on Sunday and 2:00 a.m. on the following Monday when that
11 Sunday is the day before New Year’s Day. The liquor control
12 license fee or beer permit fee of licensees and permittees
13 permitted to sell or dispense liquor, wine, or beer on a Sunday
14 when that Sunday is the day before New Year’s Day shall not be
15 increased because of this privilege. The special privileges
16 granted in this section are in force only during the specified
17 times provided in this section.
