AN ACT
RELATING TO NOTICE REQUIREMENTS PRIOR TO DISCONTINUING
FLUORIDATION IN A PUBLIC WATER SUPPLY SYSTEM.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. NEW SECTION. 135.39E Fluoridation in public
2 water supply —— notice of discontinuance.
3 1. At least ninety days prior to taking any action to
4 permanently discontinue fluoridation in its water supply, an
5 owner or operator of a public water supply system, as defined
6 in section 455B.171, shall provide notice to the oral and
7 health delivery system bureau established in section 135.15 and
8 the public water supply system’s customers.
9 2. In order to provide notice to its customers, the owner or
10 operator of the public water supply system shall place a notice
11 on each customer’s water bill or provide notice in a way that
12 is reasonably calculated so that all customers will receive the
13 notice.

14 3. Section 135.38 does not apply to violations of this
15 section.
