A BILL FOR
1 An Act relating to massage therapy, including licenses to
2 practice massage therapy and reports of child and dependent
3 adult abuse.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 152C.3, subsection 3, Code 2021, is
2 amended to read as follows:
3 3. A massage therapist licensed pursuant to this chapter
4 shall be issued a license number and a license certificate. A
5 license certificate issued pursuant to this subsection shall
6 include a photograph of the licensee.
7 Sec. 2. Section 232.69, subsection 1, paragraph b, Code
8 2021, is amended by adding the following new subparagraph:
9 NEW SUBPARAGRAPH. (15) A massage therapist licensed
10 pursuant to chapter 152C.
11 Sec. 3. Section 235B.3, subsection 2, Code 2021, is amended
12 by adding the following new paragraph:
13 NEW PARAGRAPH. i. A massage therapist licensed pursuant to
14 chapter 152C.
15 EXPLANATION
16 The inclusion of this explanation does not constitute agreement with
17 the explanation’s substance by the members of the general assembly.
18 This bill relates to the practice of massage therapy. The
19 bill requires a license certificate issued to a licensed
20 massage therapist to include a photograph of the licensee.
21 The bill also adds licensed massage therapists to the list of
22 persons required to report child and dependent adult abuse.
23 By operation of law, such persons are required to complete
24 training regarding the identification and reporting of child
25 and dependent adult abuse, and the board of massage therapy
26 is required to require the completion of such training as
27 a condition of licensure. A person required to report a
28 suspected case of child or dependent adult abuse who knowingly
29 and willfully fails to do so is guilty of a simple misdemeanor.
30 A simple misdemeanor is punishable by confinement for no more
31 than 30 days and a fine of at least $105 but not more than $855.
32 A person required to report suspected child or dependent adult
33 abuse who knowingly fails to do so is civilly liable for the
34 damages proximately caused by such a failure.
