1 An Act relating to the construction of the Iowa civil rights
2 Act of 1965 regarding sex and gender identity.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 216.18, Code 2021, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 3. This chapter shall not be construed such
4 that a right afforded to a person under this chapter based on
5 the person’s gender identity interferes with a right afforded
6 under this chapter based on a person’s sex, particularly if the
7 person claiming a right based on sex is a woman. “Woman” for
8 purposes of this subsection means a person born with female
9 genitalia and reproductive organs.
10 EXPLANATION
11 The inclusion of this explanation does not constitute agreement with
12 the explanation’s substance by the members of the general assembly.
13 This bill provides that, if in conflict, rights provided
14 on the basis of sex under the Iowa civil rights Act of 1965
15 have priority over the rights afforded to a person under the
16 Iowa civil rights Act of 1965 based on the person’s gender
17 identity, particularly if the right provided on the basis of
18 sex is claimed by a woman. The bill defines “woman” as a person
19 born with female genitalia and reproductive organs. Current
20 law defines “gender identity” as the gender-related identity of
21 a person, regardless of the person’s assigned sex at birth.
