1 An Act relating to the use of fees collected by a county
2 recorder for filing and recording instruments in the county
3 recorder’s office.

1 Section 1. Section 331.604, subsection 3, paragraph b,
2 subparagraph (5), Code 2021, is amended to read as follows:
3 (5) Fees collected in excess of the amount needed for the
4 purposes specified in this subsection shall be used by the
5 county land record information system to reduce or eliminate
6 service fees for electronic submission of documents and
7 instruments. Additionally, the county land record information
8 system may use excess service fees collected from the
9 electronic submission of documents and instruments to fund the
10 processing of documents and instruments to identify and redact
11 any personally identifiable information in recorded documents
12 and instruments, improve the consistency and accessibility of
13 land records information, and facilitate integrations with
14 other land records information systems.
15 EXPLANATION
16 The inclusion of this explanation does not constitute agreement with
17 the explanation’s substance by the members of the general assembly.
18 This bill relates to fees collected by a county recorder
19 for filing or recording an instrument in the county recorder’s
20 office. Current law requires a county recorder to collect fees
21 for filing or recording instruments in the county recorder’s
22 office, which fees shall be used for purposes specified by law.
23 If fees collected exceed the amount necessary to fulfill those
24 specified purposes, the county land record information system
25 shall use the excess fees to reduce or eliminate service fees
26 for electronic submission of documents and instruments. The
27 bill authorizes the county land record information system to
28 also use excess service fees collected from the electronic
29 submission of documents and instruments to fund the processing
30 of documents and instruments to identify and redact any
31 personally identifiable information in recorded documents and
32 instruments, improve the consistency and accessibility of land
33 records information, and facilitate integrations with other
34 land records information systems.
