A BILL FOR
1 An Act creating a public safety equipment fund, and including
2 effective date provisions.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 80.48 Public safety equipment fund.
2 1. A public safety equipment fund is created in the state
3 treasury under the control of the department. The fund shall
4 consist of moneys appropriated to or deposited in the fund.
5 Moneys in the fund are appropriated to the department for the
6 purchase, maintenance, and replacement of equipment used by
7 the department. The department is authorized to designate
8 moneys in the fund for the future purchase, maintenance, and
9 replacement of equipment used by the department.
10 2. Notwithstanding section 8.33, moneys in the fund
11 that remain unencumbered or unobligated at the close of a
12 fiscal year shall not revert but shall remain available for
13 expenditure for the purposes designated. Notwithstanding
14 section 12C.7, subsection 2, interest or earnings on moneys in
15 the fund shall be credited to the fund.
16 3. The department shall submit a report to the
17 co-chairpersons and ranking members of the joint appropriations
18 subcommittee on the justice system and to the legislative
19 services agency on or before December 31 of each year which
20 shall contain all of the following:
21 a. A list of all expenditures from the fund made in the
22 previous fiscal year.
23 b. The amount of moneys in the fund carried over from
24 the previous fiscal year to the current fiscal year and
25 how the department plans to use those moneys, including any
26 expenditures in the current fiscal year.
27 c. The amount of moneys in the fund the department intends
28 to carry over from the current fiscal year to the next fiscal
29 year and how the department plans to use those moneys.
30 Sec. 2. EFFECTIVE DATE. This Act takes effect January 1,
31 2022.
32 EXPLANATION
33 The inclusion of this explanation does not constitute agreement with
34 the explanation’s substance by the members of the general assembly.

1 appropriates the moneys in the fund to the department of public
2 safety (DPS) for the purchase, maintenance, and replacement
3 of equipment used by DPS. The fund consists of moneys
4 appropriated to or deposited in the fund. The bill authorizes
5 DPS to designate moneys in the fund for future purchase,
6 maintenance, and replacement of equipment used by DPS. The
7 bill also provides for certain reporting requirements regarding
8 how the moneys in the fund are used, including the amount
9 carried over annually in the fund.
10 The bill takes effect January 1, 2022.
