1 An Act relating to authorized transfers of school district
2 funds to the student activity fund.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 298A.8, subsection 1, Code 2021, is
2 amended to read as follows:
3 1. The student activity fund is a special revenue fund.
4 A student activity fund must be established in any school
5 corporation receiving money from student-related activities
6 such as admissions, activity fees, student dues, student
7 fund-raising events, or other student-related cocurricular or
8 extracurricular activities. Moneys in this fund shall be used
9 to support only the cocurricular or extracurricular program
10 defined in department of education administrative rules.
11 Sec. 2. Section 298A.8, Code 2021, is amended by adding the
12 following new subsection:
13 NEW SUBSECTION. 3. For the school budget year beginning
14 July 1, 2021, and the school budget year beginning July 1,
15 2022, the board of directors may, by board resolution and
16 notwithstanding any provision of law to the contrary, transfer
17 from the school corporation’s general fund or any other fund
18 of the school corporation to the student activity fund an
19 amount necessary, as recommended by the superintendent, to fund
20 cocurricular or extracurricular activities for which moneys
21 from student-related activities such as admissions, activity
22 fees, student dues, student fund-raising events, or other
23 student-related cocurricular or extracurricular activities fail
24 to meet the financial needs of the activity. This subsection
25 is replealed July 1, 2023.
26 EXPLANATION
27 The inclusion of this explanation does not constitute agreement with
28 the explanation’s substance by the members of the general assembly.
29 This bill provides that for the school budget year beginning
30 July 1, 2021, and the school budget year beginning July 1,
31 2022, the school board may, by resolution, transfer from
32 the school corporation’s general fund or any other fund
33 of the school corporation to the student activity fund an
34 amount necessary, as recommended by the superintendent, to
35 fund cocurricular or extracurricular activities for which

1 moneys from admissions, activity fees, student dues, student
2 fund-raising events, or other student-related cocurricular or
3 extracurricular activities fail to meet the financial needs of
4 the activity. The provision authorizing the transfers to the
5 student activity fund is repealed July 1, 2023.
6 The bill also modifies language regarding use of moneys in
7 the student activity fund to reflect current rules adopted by
8 the department of education.
