1 An Act concerning the implantation or insertion of microchips
2 or other devices in employees by employers.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 94.1 Definitions.
2 As used in this chapter, unless the context otherwise
3 requires:
4 1. “Employee” means a natural person who is employed in this
5 state for wages by an employer.
6 2. “Employer” means a person, as defined in chapter 4, who
7 in this state employs for wages a natural person.
8 Sec. 2. NEW SECTION. 94.2 Mandatory implantation of devices
9 in employees prohibited.
10 1. An employer shall not require that an employee have
11 a microchip or other device implanted or inserted in the
12 employee’s body. An employer shall not provide any incentive
13 or privilege to an employee for agreeing to have a microchip or
14 other device implanted or inserted in the employee’s body that
15 is not equally available to employees who do not so agree.
16 2. An employee may voluntarily agree to have a microchip or
17 other device implanted or inserted in the employee’s body if
18 not required or offered an incentive or privilege to do so by
19 an employer.
20 EXPLANATION
21 The inclusion of this explanation does not constitute agreement with
22 the explanation’s substance by the members of the general assembly.
23 This bill prohibits an employer from requiring that an
24 employee have a microchip or other device implanted or inserted
25 in the employee’s body. The bill also prohibits an employer
26 from providing any incentive or privilege to an employee for
27 agreeing to have a microchip or other device implanted or
28 inserted in the employee’s body that is not equally available
29 to employees who do not so agree.
30 The bill provides that an employee may voluntarily agree
31 to have a microchip or other device implanted or inserted in
32 the employee’s body if not required or offered an incentive or
33 privilege to do so by an employer.
