1 An Act relating to entering private property by persons using
2 dogs while fur harvesting or training dogs on fur-bearing
3 animals, and providing penalties.

1 Section 1. NEW SECTION. 481A.56B Using a dog while fur
2 harvesting —— training a dog —— entering private property.
3 A person using a dog while fur harvesting or training a
4 dog on a fur-bearing animal shall not allow the dog to enter
5 private property without first receiving permission from
6 the property owner. Failure to receive permission prior to
7 allowing the dog to enter private property constitutes a simple
8 misdemeanor. Additionally, a person who violates this section
9 shall be subject to civil damages as provided in sections
10 481A.130 and 481A.131. A fur-bearing animal taken in violation
11 of this section shall be subject to seizure as provided in
12 section 481A.12.
13 EXPLANATION
14 The inclusion of this explanation does not constitute agreement with
15 the explanation’s substance by the members of the general assembly.
16 This bill relates to entering private property when using
17 a dog while fur harvesting or training a dog on a fur-bearing
18 animal. Under current law, a person with a valid fur harvester
19 license may train certain dogs on any fur-bearing animals
20 at any time of the year. A person with a valid hunting or
21 fur harvester license may also train a dog on coyotes or
22 groundhogs.
23 Under the bill, a person who uses a dog while fur harvesting
24 or training a dog on a fur-bearing animal shall not allow the
25 dog to enter the property of another without first receiving
26 the property owner’s permission. A person who violates the
27 provisions of the bill commits a simple misdemeanor. A simple
28 misdemeanor is punishable by confinement for no more than 30
29 days or a fine of at least $105 but no more than $855 or by
30 both. In addition, a person who violates the provisions of
31 the bill is subject to existing civil damages in Code chapter
32 481A relating to unlawfully taking an animal. A fur-bearing
33 animal taken by a person while the person is violating the
34 provisions of the bill is subject to seizure by the director of
35 the department of natural resources or a peace officer.
