A BILL FOR
1 An Act requiring school districts and certain accredited
2 nonpublic schools to offer the pledge of allegiance and to
3 display the United States flag in the classroom during the
4 recitation of the pledge of allegiance.
5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 280.5, Code 2021, is amended to read as
2 follows:
3 280.5 Display of United States flag and Iowa state flag ——
4 pledge of allegiance.
5 1. The board of directors of each public school district
6 and the authorities in charge of each nonpublic school shall
7 provide and maintain a suitable flagstaff on each school site
8 under its control, and the United States flag and the Iowa
9 state flag shall be raised on all school days when weather
10 conditions are suitable.
11 2. The board of directors of each public school district
12 shall offer the pledge of allegiance in grades one through
13 twelve each school day. Every accredited nonpublic school
14 shall offer the pledge of allegiance in grades one through
15 twelve unless the authorities in charge of the school determine
16 that the requirement conflicts with the school’s religious
17 doctrines. Each classroom in which the pledge of allegiance is
18 recited pursuant to this subsection shall display the United
19 States flag during the recitation. A student shall not be
20 compelled against the student’s objections or those of the
21 student’s parent or guardian to recite the pledge.
22 EXPLANATION
23 The inclusion of this explanation does not constitute agreement with
24 the explanation’s substance by the members of the general assembly.
25 This bill requires that school districts and accredited
26 nonpublic schools offer the pledge of allegiance in grades one
27 through twelve each school day and display the United States
28 flag in the classroom during the recitation. An accredited
29 nonpublic school need not comply if the requirement conflicts
30 with the school’s religious doctrine. A student shall not be
31 compelled to recite the pledge against the objection of the
32 student or the objection of the student’s parent or guardian.
