1 An Act relating to required considerations by a county
2 compensation board.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 331.907, subsection 1, Code 2021, is
2 amended to read as follows:
3 1. The annual compensation of the auditor, treasurer,
4 recorder, sheriff, county attorney, and supervisors shall
5 be determined as provided in this section. The county
6 compensation board annually shall review the compensation
7 paid to comparable officers in other counties of this state,
8 other states, private enterprise, and the federal government,
9 and shall consider the current economic health of the county,
10 state, and country. In setting the salary of the county
11 sheriff, the county compensation board shall consider setting
12 the sheriff’s salary so that it is comparable to salaries
13 paid to professional law enforcement administrators and
14 command officers of the state patrol, the division of criminal
15 investigation of the department of public safety, and city
16 police agencies in this state. The county compensation
17 board shall prepare a compensation schedule for the elective
18 county officers for the succeeding fiscal year. The county
19 compensation board shall provide documentation to the board of
20 supervisors that demonstrates how the county compensation board
21 determined the recommended compensation schedule, including by
22 providing the applicable compensation information for counties
23 in this state with a similar population and all the adjacent
24 counties in this state. A recommended compensation schedule
25 requires a majority vote of the membership of the county
26 compensation board.
27 EXPLANATION
28 The inclusion of this explanation does not constitute agreement with
29 the explanation’s substance by the members of the general assembly.
30 This bill relates to the duties of a county compensation
31 board when recommending a compensation schedule. Under current
32 law, a county compensation board recommends a compensation
33 schedule for elective county officers for the succeeding
34 fiscal year and submits the recommended compensation schedule
35 to the county board of supervisors for approval. When

1 determining the recommended compensation schedule, current
2 law requires the county compensation board to review the
3 compensation paid to comparable officers in other counties
4 of this state, other states, in private enterprise, in the
5 federal government, and, in the case of the county sheriff’s
6 salary, other law enforcement agencies. The bill requires the
7 county compensation board to also consider the current economic
8 health of the county, state, and country when recommending the
9 compensation schedule.
10 The bill also requires the county compensation board
11 to provide documentation to the board of supervisors that
12 demonstrates how the county compensation board determined the
13 recommended compensation schedule, including by providing the
14 applicable compensation information for counties in this state
15 with a similar population and all the adjacent counties in this
16 state.
