1 An Act relating to temporary parental discretion for the
2 retention of a student at grade level.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. STUDENT GRADE LEVEL PROMOTION DURING THE
2 2021-2022 SCHOOL YEAR.
3 1. For the school year beginning July 1, 2021, and ending
4 June 30, 2022, due to the disruptions experienced by school
5 districts, accredited nonpublic schools, parents, and students
6 during the 2020-2021 school year, if a parent submits to the
7 administrator of the school, prior to August 15, 2021, a
8 written request that the parent’s child be retained at the
9 grade level in which the child was enrolled during the school
10 year beginning July 1, 2020, because the child did not make
11 adequate progress for promotion to the next grade level, the
12 board of directors of a school district or the authorities
13 in charge of an accredited nonpublic school, as appropriate,
14 shall not promote the student to the next grade level but shall
15 retain the student at the 2020-2021 grade level for the school
16 year beginning July 1, 2021. However, if during the school
17 year beginning July 1, 2021, the school administrator and the
18 student’s classroom teacher provide evidence to the parent that
19 the student has made adequate progress, the student’s parent
20 may withdraw the request and the student may be promoted to the
21 next grade level.
22 2. For purposes of this section, “parent” means a parent,
23 guardian, or legal custodian of a child of compulsory
24 attendance age.
25 EXPLANATION
26 The inclusion of this explanation does not constitute agreement with
27 the explanation’s substance by the members of the general assembly.
28 This bill allows a parent, due to the disruptions
29 experienced by school districts, accredited nonpublic schools,
30 parents, and students during the 2020-2021 school year,
31 to submit to the administrator of the public or accredited
32 nonpublic school of enrollment, prior to August 15, 2021, a
33 written request that the parent’s child be retained at the
34 grade level in which the child was enrolled during the school
35 year beginning July 1, 2020, if the child did not make adequate

1 progress for promotion to the next grade level, and the school
2 shall not promote the student to the next grade level for the
3 school year beginning July 1, 2021.
4 However, if during the school year beginning July 1, 2021,
5 the school administrator and the student’s classroom teacher
6 provide evidence to the parent that the student has made
7 adequate progress, the student’s parent may withdraw the
8 request and the student may be promoted to the next grade level
9 prior to the end of the 2021-2022 school year.
10 The bill defines “parent” to include a parent, guardian, or
11 legal custodian of a child of compulsory attendance age.
