1 An Act relating to notice requirements prior to discontinuing
2 fluoridation in a public water supply system, and making
3 penalties applicable.

1 Section 1. NEW SECTION. 135.39E Fluoridation in public
2 water supply —— notice of discontinuance.
3 1. At least ninety days prior to taking any action to
4 discontinue fluoridation in its water supply, an owner or
5 operator of a public water supply system, as defined in section
6 455B.171, shall provide notice to all of the following:
7 a. The local board.
8 b. The department.
9 c. The public water supply system’s customers.
10 2. In order to provide notice to its customers, the owner or
11 operator of the public water supply system shall place a notice
12 on each customer’s water bill or provide notice in a way that
13 is reasonably calculated so that all customers will receive the
14 notice.
15 EXPLANATION
16 The inclusion of this explanation does not constitute agreement with
17 the explanation’s substance by the members of the general assembly.
18 This bill relates to requirements for providing notice
19 prior to discontinuing fluoridation in a public water supply
20 system. For purposes of the bill, a public water supply system
21 provides to the public piped water for human consumption and
22 has at least 15 service connections or regularly serves at
23 least 25 individuals. A public water supply system includes
24 any source of water and any collection, treatment, storage, and
25 distribution facilities under control of the operator of the
26 system and used primarily in connection with the system, and
27 any collection or pretreatment storage facilities not under
28 such control that are used primarily in connection with the
29 system.
30 The bill requires the owner or operator of a public water
31 supply system to provide notice to the local board of health,
32 the department of public health, and the public water supply
33 system’s customers at least 90 days prior to taking any action
34 to discontinue fluoridation in the system’s water supply. The
35 owner or operator of the system shall provide notice to its

1 customers by placing a notice on each customer’s water bill or
2 by providing notice in a way that is reasonably calculated so
3 that all customers will receive the notice.
4 By operation of law, a person who knowingly violates the
5 provisions of the bill is guilty of a simple misdemeanor. A
6 simple misdemeanor is punishable by confinement for no more
7 than 30 days and a fine of at least $105 but not more than $855.
