1 An Act relating to the use of recording devices on private
2 property by state entities and including effective date
3 provisions.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 27B.1 Definition.
2 For purposes of this chapter, “search warrant” means a search
3 warrant issued pursuant to chapter 808.
4 Sec. 2. NEW SECTION. 27B.2 Recording devices —— private
5 property.
6 A state agency, state official, or state employee shall not
7 place a photo, video, or audio recording device on private
8 property in this state without obtaining either a search
9 warrant or express permission from an owner of the property.
10 Sec. 3. NEW SECTION. 27B.3 Removal of devices.
11 On or before July 1, 2021, a state agency, state official,
12 or state employee that has placed a photo, video, or audio
13 recording device on private property in this state in violation
14 of section 27B.2 shall cease using and remove the photo, video,
15 or audio recording device.
16 Sec. 4. EFFECTIVE DATE. This Act, being deemed of immediate
17 importance, takes effect upon enactment.
18 EXPLANATION
19 The inclusion of this explanation does not constitute agreement with
20 the explanation’s substance by the members of the general assembly.
21 This bill prohibits a state agency, state official, or state
22 employee from placing a photo, video, or audio recording device
23 on private property in Iowa without obtaining either a search
24 warrant or express permission from an owner of the property.
25 The bill requires a state agency, state official, or state
26 employee that has placed a photo, video, or audio recording
27 device on private property in violation of the bill to cease
28 using and remove the photo, video, or audio recording device on
29 or before July 1, 2021.
30 The bill takes effect upon enactment.
