1 Section 1. NEW SECTION. 915.36A Minor prosecuting witness
2 —— pretrial contact.
3 A prosecuting witness who is a minor, as defined in section
4 599.1, in a criminal case involving a public offense or a
5 delinquent act, other than a simple misdemeanor, shall have the
6 right to refuse a pretrial interview, pretrial deposition, or
7 any other discovery request involving direct contact with the
8 defendant.
9 EXPLANATION
10 The inclusion of this explanation does not constitute agreement with
11 the explanation’s substance by the members of the general assembly.
12 This bill relates to pretrial contact between a prosecuting
13 witness who is a minor and the defendant.
14 The bill provides that a prosecuting witness who is a
15 minor, as defined in Code section 599.1, in a criminal case
16 involving a public offense or a delinquent act, other than a
17 simple misdemeanor, shall have the right to refuse a pretrial
18 interview, pretrial deposition, or any other discovery request
19 involving direct contact with the defendant.
