1 An Act relating to professional standards for the certification
2 or designation of music therapists and providing penalties.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 154G.1 Definitions.
2 As used in this chapter, unless the context otherwise
3 requires:
4 1. “Music therapist” means a person who holds one of the
5 following:
6 a. An active music therapist board-certified credential
7 granted by the certification board for music therapists.
8 b. A professional designation in good standing on the
9 national music therapy registry.
10 2. “Music therapy” means the clinical and evidence-based
11 use of music interventions to accomplish individualized goals
12 for people of all ages and ability levels within a therapeutic
13 relationship by a music therapist.
14 Sec. 2. NEW SECTION. 154G.2 Practice or use of title.
15 1. A person shall not profess to be a music therapist or
16 board-certified music therapist or use the initials “MT-BC”
17 or any other words, letters, abbreviations, or insignia
18 indicating or implying that the person is a music therapist
19 unless the person holds and maintains the music therapist
20 board-certified credential granted by the certification board
21 for music therapists or is designated as a registered music
22 therapist, certified music therapist, or advanced certified
23 music therapist and is in good standing on the national music
24 therapy registry.
25 2. This chapter does not prohibit a person from using music
26 in the performance of the person’s profession or occupation
27 if the person does not represent that the person is a music
28 therapist.
29 3. A person who recklessly, knowingly, or intentionally
30 violates this section is guilty of a simple misdemeanor.
31 EXPLANATION
32 The inclusion of this explanation does not constitute agreement with
33 the explanation’s substance by the members of the general assembly.
34 This bill requires any person claiming to be a music
35 therapist to hold a music therapist board-certified credential

1 granted by the certification board for music therapists or
2 a professional designation in good standing listed on the
3 national music therapy registry. A person who recklessly,
4 knowingly, or intentionally violates the bill is guilty of a
5 simple misdemeanor. A simple misdemeanor is punishable by
6 confinement for no more than 30 days or a fine of at least $105
7 but not more than $855 or by both.
