HOUSE RESOLUTION

 

 

URGING THE UNITED STATES CONGRESS TO AMEND THE CONSTITUTION TO SPECIFY THAT NINE JUSTICES SHALL SERVE ON THE SUPREME COURT.

 

 

 


        WHEREAS, the United States Supreme Court (Supreme Court) has comprised a chief justice and eight associate justices for more than one hundred fifty years; and

 

        WHEREAS, the role of the Supreme Court as the final legal interpreter of the United States Constitution (Constitution) requires the Court to remain independent and non-partisan; and

 

        WHEREAS, if the President or Congress of the United States can unilaterally change the composition of the Supreme Court, the Court's independence and integrity are compromised; and

 

        WHEREAS, previous attempts to increase the number of justices on the Supreme Court have been summarily rejected and widely condemned by members of both political parties; now, therefore,

 

        BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2021, that the United States Congress is urged to amend the Constitution, subject to ratification by the states, to specify that nine justices shall serve on the Supreme Court; and

 

        BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the members of Hawaii's congressional delegation.
