SENATE CONCURRENT

RESOLUTION

 

 

URGING THE HAWAII DEPARTMENT OF TRANSPORTATION TO DEVELOP AND IMPLEMENT, IN CONJUNCTION WITH THE POLICE DEPARTMENT OF EACH COUNTY, AN EXPANDED STATEWIDE PUBLIC AWARENESS CAMPAIGN TO EDUCATE THE PUBLIC ABOUT THE STATE'S "MOVE OVER LAW".

 

 


        WHEREAS, according to the United States Department of Transportation, more than one hundred fifty law enforcement officers were struck and killed by vehicles between 1997 and 2019; and

 

WHEREAS, in 2012, in response to two separate vehicle-related officer deaths, Hawaii enacted a "move over law", which was codified in section 291C-27, Hawaii Revised Statutes; and

 

WHEREAS, section 291C-27, Hawaii Revised Statutes, requires that drivers, upon approaching an emergency vehicle that is stopped for an emergency, slow down to a reasonable speed and, if necessary, make a lane change into the adjacent lane; and

 

WHEREAS, on May 14, 2019, the Hawaii Department of Transportation posted a short public service announcement on its YouTube channel to raise public awareness of the State's "move over law"; and

 

WHEREAS, the recent death of a tow truck driver who was struck and killed by a vehicle while responding to an emergency on the H-2 freeway demonstrates that noncompliance with the State's "move over law" remains an issue; and

 

WHEREAS, a more effective public awareness campaign will help to increase compliance with the State's "move over law"; now, therefore,

 

        BE IT RESOLVED by the Senate of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2021, the House of Representatives concurring, that the Hawaii Department of Transportation is urged to develop and implement, in conjunction with the respective police departments of the City and County of Honolulu and the counties of Hawaii, Kauai, and Maui, an expanded statewide public awareness campaign to educate the public about the State's "move over law", as codified in section 291C-27, Hawaii Revised Statutes; and

 

        BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation and respective police chiefs of the City and County of Honolulu and the counties of Hawaii, Kauai, and Maui.
